Fatality Assessment and Control Evaluation (FACE) Program

U.S. workplace deaths remain a public health crisis, with over 5,000 annual fatalities concentrated in high-risk sectors like construction, transportation, and agriculture. To address this under the OSH Act, NIOSH runs the Fatality Assessment and Control Evaluation (FACE) program, a non-regulatory initiative providing safety guidance through independent, non-enforcement investigations. Structurally, FACE operates as a unified effort split into two distinct, complementary branches: a centralized, national In-House program run directly by NIOSH, and a decentralized network of State FACE programs funded via cooperative agreements. While both share common goals and methods, they differ significantly in their organizational structure, authority, influence, and how they implement findings locally across diverse regional industries. Together, they generate extensive prevention resources and adapt to emerging workplace hazards.

Staff at the site called 911 and began cardiopulmonary resuscitation (CPR). She was transported to a regional trauma center where she remained on life support until she died on January 7. The Massachusetts FACE Program learned of the incident from the Occupational Safety and Health Administration (OSHA) on January 13, 2022, and initiated steps to collect relevant documentation to investigate the event. Several records were reviewed in the course of the investigation, including data from the electronic death registration system (death certificate) AB - medical records from the January event and one prior asthma exacerbation at the workplace requiring transport by ambulance to the local hospital AB - additional prior medical records describing her health history AB - public obituary and news coverage AB - and records from OSHA, including publicly available records listing citations and abatement steps recommended in the hazard alert letter. Massachusetts FACE staff spoke with the next of kin of the worker to gather a more detailed health history. Massachusetts FACE staff also spoke with representatives from the company and toured the facility with senior site safety staff to view the equipment and workspace and discuss the event and safety and health policies. CONTRIBUTING FACTORS - Key contributing factors identified in this investigation include: 1) Failure to recognize ground cannabis as a potential occupational respiratory hazard. 2) Failure to adequately control the spread of airborne cannabis dust. 3) Lack of a comprehensive safety and health program and overall safety training. RECOMMENDATIONS - Massachusetts FACE investigators concluded that, to help prevent similar occurrences, employers should: 1) Assess and control hazardous materials in the workplace, including asthmagens. 2) Ensure that all workers are properly trained about hazardous materials in the workplace. 3) Develop and implement a comprehensive safety and health program that addresses hazard recognition, avoidance of unsafe conditions, and proper use of equipment. The co-owner arrived in the morning to work on a levee maintenance project. Workers were getting ready to remove topsoil before excavating the site. He parked his pickup truck and got out on the dirt road. The site superintendent drove up to him in a commercial heavy-duty, chassis cab work truck. The co-owner got in the work truck and drove with the superintendent to a spot nearby. The superintendent asked the co-owner to get out and walk back to his pickup truck to make room for another worker who arrived and got in. The superintendent then started backing to a turnaround area on the side of the road. He backed about 100 feet when a dump truck driver behind him yelled over the radio for him to stop. His passenger told him he had backed over the co-owner. The superintendent hit the brakes, got out of the truck, and found the co-owner lying face down under it. He called 911, who told him to pull the co-owner out and start CPR. Several workers came to comfort the badly injured man, trying to keep him alive. First responders arrived quickly, but he died at the scene. Following the incident, investigators found: The co-owner was wearing a hi-visibility vest, but the superintendent and passenger still did not see him in the truck's side and rear view mirrors or sense when he was struck. A steel tube headache rack and fuel transfer tank hose reel on the truck's flatbed deck partially obstructed visibility through the rear cab window. The work truck had not been inspected annually as required by federal motor carrier safety regulations. REQUIREMENTS: Employers must: When operating vehicles on construction sites, other than passenger cars and pickups, with an obstructed view to the rear: You must prohibit the use of any motor vehicle equipment that has an obstructed view to the rear unless the vehicle meets one of the following: Has an operable automatic reverse signal alarm audible above the surrounding noise level and audible no less than 15 feet from the rear of the vehicle; Or is backed up when an observer signals that it is safe to do so. Comply with annual commercial motor vehicle inspection requirements. RECOMMENDATIONS: FACE investigators concluded that to help prevent similar occurrences employers should: Create and enforce vehicle backing safety policies in their accident prevention program (APP) that: Drivers maintain clear visibility of workers on foot. When visibility is lost, drivers should stop and not resume movement until visibility is re-established. Workers stay out of backing zones unless trained and acting as an observer signaling the driver. Prohibit workers on foot from using radios or phones when crossing roads when there is vehicle traffic. Increase availability of vehicle turnaround areas on construction site roads to minimize backing distances. One of the items was to pressure wash the long driveway of mud and dirt left behind by the construction. While the worker pressure washed the driveway, the manager went to finish painting the side of the garage. As the worker was pressure washing the driveway, a worker from a landscaping business arrived and parked a commercial medium duty dump truck at the top of the driveway. The truck was loaded with pallets of small pavers, stepping-stones, and crushed rock. The top of the driveway had a very slight, hardly visible slope. The driver told the worker he was going to talk with the homeowner to ask where to put the materials. He left the truck unattended. The worker continued to pressure wash the driveway while the driver went to see the homeowner. Approximately six minutes later the dump truck rolled down the driveway, striking the worker, whose back was towards the truck. No one saw the incident, but the driver, homeowner, and project manager heard the truck roll away and crash. After they saw the truck in a nearby ditch, they came to the front of the house and found the worker facedown in the driveway. First responders pronounced him dead at the scene. Following the incident, investigators found: The dump truck was parked in first gear. The emergency brake was set but did not work. The dump truck was being leased from another landscaping business that owned it. The owner/lessor of the dump truck did not have the required annual DOT commercial motor vehicle inspection done on the truck and knew the emergency brake did not work. REQUIREMENTS: Employers must: Make sure vehicles on construction sites have parking brakes that are maintained in operable condition, engaged properly, and inspected for safety before each shift. Not allow operation of a commercial motor vehicle that is in such a condition as to likely cause an accident or a breakdown of the vehicle. Comply with annual commercial motor vehicle inspection requirements. RECOMMENDATIONS: FACE investigators concluded that to help prevent similar occurrences employers should: Request subcontractors to show current maintenance and safety inspection records, including annual DOT inspection stickers, for any commercial vehicles they own or lease that will be used on the construction site. Do not allow unsafe vehicles to drive on site. Advise site owners to ask other contractors they hire directly to show safety inspection records for any commercial vehicles before they drive on site. Emphasize the need to prevent hazardous vehicle rollaways on site. When he did not return to his workstation, the site supervisor went looking for him and noticed about 50-75 tons of nuts spilling out of the open access hatch to one of the 850 ton silos onsite. The site supervisor called a team of co-workers to clean up the spill, and after a few minutes they found the unresponsive victim buried under the nuts. The site supervisor called 911 and several co-workers performed CPR until emergency services arrived. Paramedics arrived but were unable to revive the victim, and he died from asphyxiation. CONTRIBUTING FACTORS - 1) The staffing agency did not conduct a thorough Job Hazard Analysis (JHA) to identify hazards prior to assigning their employee to the client site. 2) The staffing agency did not provide adequate training to their employee prior to assigning him to the client site. 3) The nut processing facility did not have a system in place to ensure filled silos were locked and inaccessible. RECOMMENDATIONS - California FACE (CA/FACE) investigators concluded that to help prevent similar occurrences, staffing agencies who provide temporary staffing, and operating nut processing facilities should: 1) Conduct a thorough JHA at their client's facilities to identify all hazards to which their employees may be exposed and provide safety training to their employees prior to assignment. 2) Install inner doors inside of silo access hatches that swing inward to prevent catastrophic spillage. 3) Develop and implement a Standard Operating Procedure (SOP) for opening and entering silos. They tried calling his phone, but he had left it in the work passenger van. The crew notified the supervisor about the missing employee. Other work crew employees went into the field to look for the missing farm worker and found him unconscious and face down where he had been working. The other work crew members moved him to a shaded area nearby. Emergency response was called and arrived at the scene in approximately 10 minutes. CONTRIBUTING FACTORS- Key contributing factors identified in the investigation include: 1) Environmental heat exposure and lack of acclimatization AB - 2) Failure to implement a work/rest schedule based on heat exposure AB - 3) Lack of adequate shaded areas and consumption of water AB - 4) Inadequate communication with a supervisor or electronic tracking of heat stress symptoms AB - 5) Lack of training on the hazards of heat exposure. The tractor had a set of forks attached to the rear 3-point hitch. The tractor had a rollover protective structure (ROPS) and a seat belt installed, but the operator was not using them. The operator drove the tractor down a steep, rocky, uneven dirt road, which had an 18-21 degree grade. When he tried to make a right turn at the bottom of the hill, the tractor rolled to the left, and threw him to the ground towards the rear of the tractor. When the tractor rolled onto its side, the lower portion of the forks landed on the operator's skull. Although no one saw the incident, another operator saw the tractor on its side and yelled to a manager who was nearby. When they found the worker face down, gasping for air, the manager called 911. First responders arrived minutes later and pronounced the worker dead at the scene. Following the incident, investigators found: The tractor's ROPS was not in the upright position even though no substantial overhead obstructions were present. The employer did not ensure tractor ROPS was used as required. The tractor's seat belt had a faulty retractor and webbing covered with caked dirt, indicating it had not been used recently. The employer did not ensure tractor seat belts were used as required. The employer did not provide tractor operator safety training and skill and knowledge evaluations. Excessive speed could have been a contributing factor as a manager warned the operator to slow down about 15 minutes before the rollover occurred. RECOMMENDATIONS - FACE investigators concluded that to help prevent similar occurrences, employers should: Develop policy requirements for ROPS and seat belt use and tractor operator safety training in your written accident prevention program (APP). Review requirements with operators frequently. Provide ample supervision of tractor operators and always enforce tractor safety policy requirements. Provide documented, hands-on tractor operator training, including refresher training, on a regular, ongoing basis. Ensure the training emphasizes showing operators how to prevent rollovers by avoiding excessive speed, navigating rough and steep terrain, and maintaining a safe turning radius. The foreman had been at the construction site of a new single-story commercial building for almost a month. On the incident day, he was alone on top of the building constructing a plywood roof deck. He was using a personal fall arrest system (PFAS), including anchorage, lifeline, rope grab, body harness, and shock-absorbing lanyard. A framing helper was assisting from the ground by using a scissor lift to hand him tools and materials. The foreman was laying plywood sheets onto trusses that had brackets on each receiving end where the sheets would be set. He was using his heel to kick the sheets into the brackets. When he tried moving a sheet with his feet, it gave way and dropped under his weight. He fell 17 feet to the ground inside the building with the sheet landing beside him. The helper was outside the building and did not see the fall. A manager watching live-streamed job site surveillance video in the office saw the worker on the ground, had the helper check him, and called 911. He died at the hospital after six days on life-support. Following the incident, investigators found: The worker's PFAS was in excess of 50 feet for a 17-foot fall. An unnecessary second shock-absorbing lanyard was connected to the anchorage. His chest strap was not connected and the leg straps were loose. If the worker had the correct fall distance needed for his PFAS to engage and arrest his fall, it is likely his body still would have slipped out of the harness. The employer did not provide adequate fall protection training, specifically: How to evaluate the fall clearance needed in order to select, install and use an appropriate PFAS. How to engage all connectors to ensure the worker stays fully secured in the harness during a fall. The trimmer was a certified arborist for a commercial and residential tree service and landscaping company who shared his expertise in online videos and on social media. He was sent with a three-person crew to fall a storm-damaged bigleaf maple in the backyard of a private residence. He was in charge of the crew and job site. The maple was supporting two uprooted Douglas firs and a mass of broken branches. The firs were to fall when the maple was cut down. The trimmer climbed to the top of the maple, cut a few branches with a chainsaw, and climbed back down to cut the remaining 38-foot section of the tree to a low stump. He performed the face cut, followed by the back cut, at the base of the tree. As he began cutting, a limb broke off a fir tree and got hung up in the canopy without anyone noticing. The limb was 14-feet long, around four inches thick, and weighed between 70 to 100 pounds. While doing the back cut, the maple formed a vertical crack that dislodged the broken limb. When the trimmer looked up toward the sound of the crack, the limb fell straight down, striking him in the forehead. A crewmember called 911 and began CPR until first responders arrived and pronounced the trimmer dead at the scene. Following the incident, investigators found: Tree workers were exposed to being struck from above by loose or broken limbs. Crew members who were standing by were not positioned at a safe distance from the tree at least two times the height of the tree or trunk being removed. The employer's accident prevention program (APP) was not effectively enforced. REQUIREMENTS: Provide employees a workplace free from recognized hazards that are causing, or are likely to cause, serious injury or death. RECOMMENDATIONS: FACE investigators concluded that, to help prevent similar incidents: Develop APP policies that requires a job site assessment before any tree removal. Identify loose limbs, hangers, broken tops, chunks, lodged trees, leaning trees, snags, and other overhead material. Assess the area for hazards and obstacles listed in ANSI Z133-2017, Section C. Manual Tree Felling Procedure. Use a bucket truck, binoculars or, where permissible, drone technology to visually detect overhead hazards concealed in the tree canopy. Plan an escape route and maintain situational awareness in the drop zone. Look up, down and all around before, during, and after tree removal. As damaged trees are being felled, use a spotter and pause often to check for hanging or lodged limbs before continuing. Stay alert for environmental changes that could worsen tree hazard risks, such as wind, snow, ice, slopes, and obscured visibility. Ensure required personal protective equipment (PPE) is worn in work area. Department of Labor and Industries AB - A 20-year-old worker lost three fingertips from his right hand when a quick coupler connecting a bucket to an excavator failed. He had been with the employer for 5 months, working as a ground person. The young worker was part of a crew setting up a shoring system. He was spotting for an operator who was using the bucket of a rented excavator to pound in a steel piling. When finished, the operator lowered the bucket to the ground. Just then, the spotter noticed the safety knuckle of the quick coupler on the ground. It had detached from the coupler where it connected the bucket to the excavator. He picked up the knuckle and moved in front of the bucket where he used his hands to feel around inside the coupler and tried to reattach the knuckle. Suddenly, the wedge of the coupler locked into place crushing his fingers between the wedge and the bucket. The incident evolved into a 3-hour, multiple agency technical rescue. The spotter lost the tips from the first three fingers of his right hand. Investigators found: The operator inspected the quick coupler earlier that day, confirmed the wedge was locked in place and there were no hydraulic leaks, and used the excavator for seven hours prior to the incident. The operator nor anyone else on site heard a detachment alarm when he lowered the bucket or when the safety knuckle detached from the coupler. No evidence of exactly what caused the knuckle to detach. The spotter did not communicate to the operator when he attempted to reattach the knuckle. REQUIREMENTS: The employer was not cited for violating safety standards. However, the following rule can prevent workers from being struck and killed by falling attachments. You must not permit any employee underneath loads handled by lifting or digging equipment. RECOMMENDATIONS: FACE investigators concluded that to help prevent similar occurrences: Train equipment operators and workers on the ground to: Never place hands inside the quick coupler or anywhere near the linkage mechanism while the hydraulic system is pressurized or the machine is on. Never attempt to repair failed equipment and to notify site supervisors when issues with equipment are suspected or noticed. Always communicate intentions and wait for confirmation before proceeding. Use an excavator-mounted pile driver instead of a bucket to drive piles. Estaba usando una escoba con mango extendido, que le permitía barrer desde una distancia segura de las partes móviles de la prensa. Elaborar, supervisar, implementar y hacer valer programas de capacitación para mejorar la habilidad, conciencia y competencia de todos sus empleados en el campo de la seguridad y salud ocupacional RECOMENDACIONES Los investigadores de FACE concluyeron que, para ayudar a prevenir sucesos similares, los empleadores deben hacer lo siguiente: Supervisar, evaluar y hacer valer los requisitos del procedimiento de bloqueo/etiquetado (LOTO, por sus siglas en inglés) de acuerdo con la capacitación de seguridad de la prensa de heno y el manual de seguridad del fabricante de la máquina. Realizar evaluaciones de riesgos con el fabricante de la máquina para mejorar las características de protección, como vallas de seguridad, protectores fijos, puertas con enclavamiento, cortinas fotoeléctricas y estaciones de parada de emergencia.
