Fatality Assessment and Control Evaluation (FACE) Program

U.S. workplace deaths remain a public health crisis, with over 5,000 annual fatalities concentrated in high-risk sectors like construction, transportation, and agriculture. To address this under the OSH Act, NIOSH runs the Fatality Assessment and Control Evaluation (FACE) program, a non-regulatory initiative providing safety guidance through independent, non-enforcement investigations. Structurally, FACE operates as a unified effort split into two distinct, complementary branches: a centralized, national In-House program run directly by NIOSH, and a decentralized network of State FACE programs funded via cooperative agreements. While both share common goals and methods, they differ significantly in their organizational structure, authority, influence, and how they implement findings locally across diverse regional industries. Together, they generate extensive prevention resources and adapt to emerging workplace hazards.

When the incident occurred, the sweeper was performing his usual duty of cleaning up hay that fell on the floor around the hay press. He was using a broom with an extended handle that allowed him to sweep at a safe distance from moving parts of the press. However, just after midnight, the sweeper entered a 10-foot wide opening under the press operator's station toward the hay bale elevator. During normal operation, the elevator lowered finished bales from the press and used a pusher to slide them across an output platform for removal and packing. The elevator was in full upward position over five feet above the floor when the sweeper walked under it. Seconds later, the elevator came down and pinned his legs on the floor and his torso on the output platform in front of him. Then, a 1,000-pound bale fell onto the elevator from the ejector above and crushed him facedown for 18 seconds before the pusher slid the bale out across his torso. Three co-workers heard a scream and ran to the elevator. The press operator saw the crushed sweeper and shut off the machine. First responders had the workers pull him from the press, but he died at the scene. Workers told investigators the sweeper knew about the machine's hazards and did not know why he entered the machine. Following the incident, investigators found: The hay press had no physical barrier to stop workers from entering the elevator while the machine was running. The employer stated no barriers were installed because the sweeper would not be able to keep the area clean. A manufacturer's warning sign above the output platform stated, "Do not enter unless elevator is on the floor-in English and Spanish. The employer's hay press safety training was more protective in instructing workers to never enter the press when it was not locked out. No sign was posted on the machine where the worker entered. The employer did not ensure their hay press safety training program was effective and enforced. REQUIREMENTS: Protect employees from hazards created by the point of operation by using one or more safeguarding methods. Develop, supervise, implement, and enforce training programs to improve the skill, awareness, and competency of all your employees in the field of occupational safety and health. RECOMMENDATIONS: FACE investigators concluded that to help prevent similar occurrences, employers should: Supervise, evaluate, and enforce worker performance of lockout/tagout (LOTO) procedure requirements according to hay press safety training and machine manufacturer's safety manual. Perform risk assessments with the machine manufacturer to improve safeguarding features, such as barrier fencing, fixed guards, interlocking gates, light curtains, and emergency stops (E-Stop) locations. The sides of the trench were steep and nearly vertical. They dug the trench in unstable Type C soil and did not use protective systems such as shoring, shields, trench boxes or sloping and benching of the sides. The day before the incident, the trench collapsed after a rainstorm. On the morning of the incident, one of the workers used the large excavator to scoop out the collapsed soil. Another worker used a smaller excavator to push the spoils pile back from the trench edge. The contractor and a laborer then used an extension ladder to enter a 10-feet deep ditch in the larger trench. The contractor located the sewer line. He then told the other workers he was going to replace a section of the old line. A few moments later, the trench wall collapsed, burying him and the laborer. The two workers died of asphyxia due to suffocation. Following the incident, investigators found: Trench protection (shoring, shielding, benching, and sloping) was not used. There was some shoring equipment on site, but it was not adequate for the trench. No safe means of egress from trench. The employer had previous safety violations, including having workers in unprotected trenches and no ladder as a means of access and egress in a trench. REQUIREMENTS: Trenches must have adequate cave-in protective systems. Ensure there is a safe way to exit a trench that is four feet or more in depth. A competent person must inspect trenches at the start of each shift and as needed during the shift and after a rainstorm to ensure that conditions are safe for employees. Remove employees from hazardous areas until precautions have been taken to ensure their safety. Sloping or benching for excavations greater than 20 feet deep shall be designed by a registered professional engineer. RECOMMENDATIONS: FACE investigators concluded that to help prevent similar occurrences: Never enter a trench or excavation that does not have an adequate protective system in place. Inspect the trench or excavation before entering. Do not assume there will be a warning sign before a cave-in or that you will have time to escape. He fell in between the tracks. When the rancher saw him fall, he ran to the machine to pull him to safety but was also run over by the machine. The operator's lunchbox had been left resting on the travel control levers causing the machine to activate when the pilot control stop bar was accidentally released. When the incident happened, the worker was alone, touching up the exterior paint of a one-story house being prepared for sale. The homeowner had arrived around 1 p.m., talked briefly with the worker, and went inside to sleep. No one else saw the worker until 7 p.m., when a home appraiser found him badly injured lying on his back. He fell onto rocks and concrete at the base of an 18- foot fully extended, portable, metal articulated or multi-positional ladder. The ladder's bottom half was leaning on a 6-foot below grade rock retaining wall near the basement entrance. The top half was resting horizontally on the ground level grass surface. The appraiser called 911 and tried to wake the homeowner. When paramedics arrived, the worker was bleeding from his head, still breathing but unresponsive. Missed call messages on a phone found in the worker's pocket led paramedics to estimate he was on the ground for about 3 hours. He was airlifted to the hospital, where he died the next day from severe head injuries. Following the incident, investigators found: The employer did not ensure the ladder was secured from accidental movement. The ladder was not in the self-supporting position with hinges locked, which created unstable work conditions that exposed the worker to a fall of around six feet. The employer did not provide documented ladder safety training and an on-site safety orientation as part of their accident prevention program (APP). The employer stated the ladder did not belong to them. REQUIREMENTS: Place the ladder either: (a) With a secure footing on a firm, level support surface; or (b) Secure the ladder to prevent accidental displacement. Train employees to recognize ladder hazards and the procedures to minimize these hazards. Develop and implement a formal, written accident prevention program (APP) with a safety orientation that includes: (g) An on-the-job review of the practices necessary to perform the initial job assignments in a safe manner. RECOMMENDATIONS: FACE investigators concluded that to help prevent similar occurrences, employers should: Ensure workers use ladders according to manufacturer's safety guidelines and warnings and maintain a 3-point contact, staying near the middle of the ladder, and facing it when climbing. Provide training to workers in each type of ladder they will use, including how to properly inspect, set up, secure, climb, relocate, transport, maintain, and store the ladder. Supervise a lone worker's safety by visiting work sites and requiring regular phone check-ins. He had worked for his employer, a new housing construction contractor and subcontractor at the site, for two years. He first used the backhoe to excavate around an electrical junction box. After doing this, he used the backhoe's loader to place gravel around the box. He then moved the backhoe to the street where he parked it. He left the engine running and the backhoe boom elevated. He exited the cab and walked to the rear of the backhoe. No one saw what happened next, though investigators determined that as he was standing at the rear of the cab where the backhoe boom attached, he reached into the cab to retrieve a metal tool called a post pounder. As he was doing this, he apparently dropped the post pounder on one of the two foot pedals that controlled the backhoe boom swing. This caused the boom to swing sideways toward him, pinning and crushing him between the boom and one of the machine's two retracted stabilizers. REQUIREMENTS: Bulldozer and scraper blades, end-loader buckets, dump bodies, and similar equipment, must be either fully lowered or blocked when being repaired or when not in use. All controls must be in the neutral position, with the motors stopped and brakes set, unless work being performed required otherwise. You must not leave tools on the cab floor. You must not store spare cans of oil or fuel, and spare parts, in cabs, except in approved racks provided for that purpose. RECOMMENDATIONS: FACE investigators concluded that to help prevent similar occurrences: Instruct equipment operators and workers on foot to: Lower the boom to a safe position with the bucket on the ground and turn off the machine before stepping off for any reason. Never place tools, parts, or other objects in the cab that have the potential to activate the foot pedals or other controls. Never stand in the pinch point of the boom of a running or operating backhoe. The city sanitation refuse truck driver was at the back driver side of the refuse truck loading trash along with a sanitation technician who was positioned at the back passenger side of the truck at the time of the incident. A male motorist in his mid-60s did not brake or change lanes away from the refuse truck and collided with the refuse truck, pinning the sanitation refuse truck driver. The sanitation refuse truck driver was transported to the hospital where he later died as a result of his crushing injuries. The crew started the job about a week before, at which point they installed anchors and nine lifelines on the roof. On the day of the incident, the crew used a boom supported elevating work platform to reach the rooftop. All wore full-body harnesses. Shortly after they started, it began to rain, which made the roof slippery. They used the platform to get down and left their lifelines about 20 feet from where they got off the roof. When the rain stopped, they used the platform to get back onto the roof. The roofer was walking toward his lifeline and about eight feet away from it when he fell from the unprotected edge. A coworker who witnessed the fall said he grabbed the steel framing as he fell but lost his hold and dropped 33 feet to the gravel warehouse floor. The foreman performed CPR, but the roofer died at the scene. Following the incident, investigators found: Fall protection equipment was not properly installed and used, specifically: o Roof anchors installed with unapproved and fewer screws than specified by the manufacturer. o Multiple lifelines attached to a single anchor. Lifelines connected together and wrapped around beams. The employer did not have a required fall protection work plan on site. A walk around safety inspection had not been documented. REQUIREMENTS Employers must: Ensure that a fall arrest system, fall restraint system, or positioning device system is provided, installed, and implemented in accordance with fall protection system specifications when employees are exposed to fall hazards of six feet or more to the ground or lower level while constructing a leading edge. Develop and implement a written fall protection work plan, including each area of the work place where the employees are assigned and where fall hazards of ten feet or more exist. Document walk-around inspections and make documentation available for review. RECOMMENDATIONS FACE investigators concluded that to help prevent similar occurrences employers should: Develop policies that require workers to always remain attached to lifelines and to place them so they are able to reattach and maintain 100% tie-off when they move between platforms and other surfaces. Provide and frequently reinforce training on proper use of fall protection equipment with emphasis on always attaching before detaching when switching lifelines so that workers maintain 100% tie-off. The attendant worked the day shift, but always arrived two hours early before the store's lone late night attendant's shift ended at 7 a.m. At 5:40 a.m., when no customers were present, an unknown gunman came in through the store's front entrance. He walked past the front counter and through a storage area door next to it. The attendant, who was at the counter, saw the gunman through a window in the door. When the attendant opened the door, the gunman turned toward him and fired twice from a .40 caliber handgun as the worker tried to flee. One bullet hit a wall, but the other hit the attendant. As the wounded attendant fell to the floor, his shooter ran away. The night shift attendant, who was in a cooler stocking shelves, called 911 as the shooting was underway. First responders declared the attendant dead at the scene. The incident was recorded on surveillance video. Detectives believed the gunman was attempting to rob the store. Following the incident, investigators found: The employer instructed workers to not resist hostile and aggressive customers, and allow shoplifters and robbers to take what they wanted. Store security measures included a written robbery response procedure, 11 surveillance cameras inside and 5 outside, windows that were not entirely covered with advertisements, ample interior and exterior lighting, a foot-activated silent panic button under the front counter to notify police during emergencies, a $100 cash register till drawer limit, and cash drop safes. REQUIREMENTS: All retail businesses operating between 11:00 p.m. and 6:00 a.m. are required to follow late night retail worker crime prevention rules. RECOMMENDATIONS: FACE investigators concluded that to help prevent similar occurrences, employers should: Develop a custom workplace violence prevention program for late-night retail establishments with site-specific policies, procedures, training, and program evaluation requirements. Conduct a workplace security analysis to identify hazards, conditions, operations, and situations that could lead to violence. If possible, hire a certified security consultant to do the analysis. Select engineering, procedural, and administrative controls from OSHA's recommendations for workplace violence prevention programs in late-night retail establishments. Controls can include changes to store layout, door access, and staffing levels. CONTRIBUTING FACTORS - Key contributing factors identified in this investigation include: 1) Bypassing equipment safety features AB - 2) Workplace substance use AB - 3) Inadequate knowledge of hazards AB - 4) Inadequate training and communication. RECOMMENDATIONS - Kentucky FACE investigators concluded that, to help prevent similar occurrences, employers should: 1) Ensure that employees do not bypass equipment safety features AB - 2) Implement measures that contribute to a drug-free work environment AB - 3) Identify and understand the hazards that may be presented by the equipment their employees operate AB - 4) Provide education and training to employees to recognize hazards and methods to mitigate and/or eliminate them. When he didn't answer his radio or return the forklift at the end of his shift, co-workers began a search for him. He was found inside the recycling baler crushed to death. California FACE (CA/FACE) investigators concluded that, to help prevent similar occurrences, employers using recycling equipment should: Ensure that all personnel who operate balers are fully trained and supervised on procedures to remove a jam properly. In addition, recycling baler manufacturers should: Design and install safety features to keep workers away from moving parts.
