Fatality Assessment and Control Evaluation (FACE) Program

U.S. workplace deaths remain a public health crisis, with over 5,000 annual fatalities concentrated in high-risk sectors like construction, transportation, and agriculture. To address this under the OSH Act, NIOSH runs the Fatality Assessment and Control Evaluation (FACE) program, a non-regulatory initiative providing safety guidance through independent, non-enforcement investigations. Structurally, FACE operates as a unified effort split into two distinct, complementary branches: a centralized, national In-House program run directly by NIOSH, and a decentralized network of State FACE programs funded via cooperative agreements. While both share common goals and methods, they differ significantly in their organizational structure, authority, influence, and how they implement findings locally across diverse regional industries. Together, they generate extensive prevention resources and adapt to emerging workplace hazards.

Needing an additional plank for the scaffolding, the victim climbed onto the house's roof to access a plank on a roof bracket located at the roof's edge. When the victim reached the roof bracket, it collapsed causing the victim and the wood plank to fall approximately 19 feet to the ground below. Both the company owner and the co-worker heard the noise of the victim and the plank falling to the ground and went to the victim. The company owner placed a call for emergency medical services (EMS). Personnel from the local fire department, EMS, and police department arrived within minutes of the call. The victim was transported to a local hospital and then was transported to a larger hospital where he was pronounced dead five days later. The Massachusetts FACE Program concluded that to prevent similar occurrences in the future, employers should: 1. Provide fall protection for all employees exposed to fall hazards of six feet or more AB - 2. Eliminate the use of adjustable roof brackets that are not equipped with locking mechanisms AB - and 3. The victim's task was to make an electrical conduit connection under the eaves of a shed attached to the house. The conduit connection was between the eaves and a small wooden awning attached above the shed door. There were no witnesses, but there are two likely scenarios. The victim may have placed a ladder against the house to the right of the awning and climbed onto the awning to connect the conduit. This may have collapsed the awning, dropping the victim to the ground where he hit his head on the concrete porch below. The second possibility is that the victim placed the ladder directly against the awning. His weight on the ladder may have caused the awning to collapse, again, sending the victim to the ground. A 24-foot extension ladder and an 8-foot folding step ladder were found on the ground; it is not known which was used. The victim was taken to a hospital and died six days later from head injuries. During summer 2011, over 4,700 Massachusetts teens were working through summer jobs programs.(2) While work can provide teens with important benefits, it can also pose health and safety risks. In fact, nationally, teen workers have about twice the risk of non-fatal on-the-job injuries per hour worked than older workers.(3) This is partly explained by the fact that teens tend to work in industries that are high risk for workers of all ages, such as restaurants and healthcare. Information about where and how teens are injured at work is essential to prevent future injuries and promote safer work opportunities for youth. Since the early 1990's the Teens at Work: Injury Surveillance and Prevention Project at the Massachusetts Department of Public Health has tracked work-related injuries to teens under age 18. Over the years, Teens at Work has collaborated with partners on a variety of initiatives to prevent injuries to working teens. And we have had some success: In this issue we report on declines in teen occupational injury rates over time. However, as the data for 2005-2009 reveal, there is still work to be done. We must continue efforts to ensure jobs in which teens are employed are safe. And, as we engage teens in the workplace - whether employers, schools, jobs programs, or parents with family businesses - we need to provide them with basic health and safety skills that will help protect them now and in the future. The California Fatality Assessment and Control Evaluation (CA/FACE) program tracks and investigates cases of fatal injuries at work, and makes prevention recommendations for employers and workers. The CA/FACE program is investigating the preventable death of a worker who was using a paint stripper inside a tank at a paint manufacturing company. A second worker was also nearly killed after attempting a rescue. What happened? The victim was working by himself using a paint stripper to remove dried paint from the inside of a tank. The product contained methylene chloride (at least 60%), methanol and mineral spirits. The tank was 7'x 7' x 9' with a 2' x 7' opening at the top, and was a permit-required confined space under California OSHA regulations. The space was not adequately ventilated and the victim was not trained in confined space entry. The company had not stationed an attendant at the tank entrance to monitor the victim while he worked in the tank. A co-worker was overcome when he attempted a rescue after seeing the victim unconscious at the bottom of the tank. The victim could not be resuscitated. The cause of death according to the local coroner was asphyxia due to inhalation of dichloromethane (methylene chloride). The co-worker was hospitalized and treated for methylene chloride poisoning. What was the cause? Both of the workers were overcome by dangerous levels of solvent vapors inside the paint tank. The paint tank was a permit-required confined space, but proper testing, entry and rescue procedures were not in place to prevent both workers from being overcome by toxic vapors. The victim was wearing a cartridge respirator that did not adequately protect against inhaling methylene chloride vapors. What should be done to prevent this from happening again? Methylene chloride has been linked by Federal OSHA to over 50 worker deaths nationwide since the mid-1980s, primarily from use in poorly ventilated spaces. Methylene chloride is also considered by many regulatory agencies in the U.S. to cause cancer, and is banned from many uses in Europe. Employers should establish procedures to clean paint tanks more frequently with water-based materials, before the paint is cured. If this is not possible, the cured paint should be stripped with abrasive removal methods. If toxic chemicals must be used inside a tank, employers must provide worker training in confined space entry and must follow OSHA regulations during an entry. This includes providing proper ventilation, supplied air respiratory protection, air monitoring, communications, and means of rescue and retrieval. The victim and an employee of the contractor were loading equipment and tools to move to another job site. The victim's task was to load a skid-steer loader with a backhoe attachment on to an equipment trailer for transport. As the victim moved the loader toward the trailer ramps, the backhoe attachment dragged on the ramps, preventing it from being loaded. He got down from the machine and connected the backhoe's hydraulic hoses and then got back into the cab. He may have intended to use the bucket of the backhoe attachment to lift the loader's front end to prevent the attachment from dragging while moving up the ramp. The victim was seated in the cab with the safety restraint bar in the down position (it must be down to operate the machine). He then stood, perhaps for a better view, and reached for the backhoe attachment operator's seat in front of him. At the same time his hand hit a button which engaged the bucket and his left foot became stuck on the control that activated the backhoe attachment. The bucket then moved toward him, pinning him between the exterior seat and the cab frame. The victim was taken to a hospital where he died of blunt force trauma to the chest. Now he cannot even bend or move without pain in his lower back. He was permanently disabled from the injury and now cannot return to his job. His workers' compensation claim cost over $500,000. Case 3: A 28-year-old truck driver bent down to pick up a tarp and felt a slight discomfort in his lower back. He ignored it and kept working, knowing he needed to get the job done. The pain progressed until a couple of days later when it became extreme. This injury caused him to be off work for nearly 3 years before he could return to gainful employment. His claim cost over $120,000. TIPS TO LIVE BY: Employers - Provide a tarping station or rolling staircase. Reduce weight from water and ice by providing a tarp storage box to keep it out of the weather. Drivers - Ask the forklift driver to put your tarp on top of the load. Use a partner to help pull off and put on the tarp. If you must lift a tarp, hold it close to your body. Stay aware of your footing on the trailer deck. Wear high-visibility clothing or vest when working around your truck. The victim and a coworker were installing carpet in a commercial building that was under construction. The workers were attempting to unload rolls of carpet from a three-sided box, also referred to as a skip box, through a window. The victim was working from inside the skip box which was elevated to an unfinished fourth story window by a variable reach all-terrain telehandler. According to his coworker, the victim had one foot on the window sill and one foot on the end of a carpet roll that was protruding from the skip box. The portion of the carpet roll the victim was standing on was not supported by either the window sill or the skip box. When the victim lifted his foot off the window sill, all his weight shifted onto the roll of carpet. The carpet roll and victim fell 32 feet to the concrete sidewalk. His head struck the concrete sidewalk, and a second roll of carpet fell out of the box and landed on him. EMS was called immediately and arrived on the scene quickly. The victim was transported to the hospital where he later died from injuries sustained from the fall. To prevent similar incidences the Washington State Fatality and Control Evaluation Team (FACE) recommends that employers, carpet installers and other workers handling materials at elevation should follow these guidelines: 1. Use a safe and approved method to elevate, handle and deliver materials at elevation. 2. Ensure that guardrails on windows at elevated heights are secured and cannot be removed except by a competent person. Use fall arrest systems when guardrails are removed and place signs or placards showing that workers should not step or lean outside window. 3. When using powered industrial trucks (PITs) such as telehandlers to elevate and deliver carpet, consider using carpet poles and rug rams. Building designers and general contractors should: 1. Integrate fall prevention strategies into the initial design of the building and throughout the construction operational plan. 2. Designate a specific competent person or persons to be responsible for developing, training, monitoring, and enforcing site-specific safety plans. Although the incident was un-witnessed, it appears that the victim was on mobile scaffolding when he fell from the scaffolding landing on the lobby floor. The victim was found by a co-worker later that same day when the co-worker had opened the school to let in two cooks for a fundraiser event that was going to take place that afternoon. The co-worker immediately placed a call for Emergency Medical Services (EMS). Within minutes EMS and the local police arrived at the incident location and the victim was transported to a local hospital where he was pronounced dead. The Massachusetts FACE Program concluded that to prevent similar occurrences in the future, schools should: 1. Ensure scaffolds are erected according to the manufacturer's guidelines and OSHA standards AB - 2. Ensure that fall protection is available and used by employees exposed to fall hazards AB - 3. Implement a buddy system for custodial staff to limit working alone from heights during off hours AB - 4. Conduct a job safety analysis (JSA) for custodial tasks to ensure proper practices and procedures are implemented enabling the task to be performed safely AB - 5. Provide all custodial staff with training on scaffolding and ladders that are used to complete tasks AB - 6. Ensure that custodial departments develop, implement, and enforce a comprehensive health and safety program AB - and 7. It's also important to carefully observe the area you are working in, even if it is your usual work area. Conditions can change quickly. TIPS TO LIVE BY: Employers - Make sure work areas have good lighting. Provide LED headlamps to all employees who work outside after dusk or before dawn. Remind workers to clean up or remove tripping hazards. Encourage workers to be aware of potential hazards and either fix them or report them. Drivers - Day or night, during your pre-trip inspection, have a light to check the locking jaws. Keep your hands free by using an LED headlamp instead of a flashlight. Carefully check the ground outside your cab and around the truck and trailer for trip or slip hazards. Wear high-visibility clothing or vest. He had made several passes. He was traveling east when the front of his tractor began to slide down into the ditch. The decedent was unable to jump off the tractor as the tractor overturned and the tractor came to rest on top of him. The decedent had been observed by a neighbor who was driving past. When the neighbor returned approximately 15 minutes later, she saw the overturned tractor and called for emergency response. Emergency response arrived and declared him dead at the scene. RECOMMENDATIONS: 1. Select an appropriate machine for the task. In this incident, a rollover protective structure (ROPS) fitted unit should be the preferred unit, but a newer tractor with a 3-point hitch rear-mounted blade or a track-type dozer with a front blade would have been better suited to move the soil. 2. Retrofit older tractors with properly designed, manufactured and installed ROPS and seat belt if an approved ROPS/seatbelt is available. 3. Limit use of narrow-front (tricycle) tractors to tasks with low risk for overturn. Tricycle tractors may not be suitable for use with push blades or front-end loaders. 4. Michigan farmers with disabilities should contact Michigan AgrAbility (800-956-4106) to obtain information and assistance to accommodate their impairment and safely farm. 5. Establish a farm safety plan. Although the following recommendation would not have prevented this fatality, MIFACE concluded that as a matter of prudent safe tractor operation, farmers should, ensure any implement of husbandry, such as a tractor, when used on a public roadway has a slow moving vehicle sign. One of the two students was assigned a task of using an existing de-energized wire located in a ceiling as a snake to feed a new higher voltage wire. While standing on a ladder, the student mistakenly grabbed a wire that was energized, resulting in an electrical shock. The second incident involved a student who was shocked while feeding wire into a piece of metal conduit, a task that reportedly went beyond the assigned scope of work AB - the wire was live and caused the metal conduit to become electrified shocking the student. In both cases, the students were being supervised by an instructor, but during the actual time of these incidents the instructor had stepped away to check on other Electrical Technology program students. The school nurse was called for both injuries and performed an evaluation of the students and then called for Emergency Medical Services (EMS). EMS responded to each incident within minutes and transported the students by ambulances to local hospitals. Both students were released from the hospital on the same day they were injured. The Massachusetts Department of Public Health concluded that to prevent similar occurrences in the future, schools with vocational shops should: 1) Develop comprehensive safety and health plans, as required by Massachusetts regulations, to protect both students and school personnel by ensuring that schools are providing conditions that, at a minimum, meet occupational safety and health standards set by the Occupational Safety and Health Administration (OSHA) AB - 2) Conduct a job safety analysis (JSA) for each assigned task to ensure proper practices and procedures are implemented enabling the task to be performed safely AB - and 3) Routinely review and enforce lockout/tagout programs and provide relevant training to students and school staff. An estimated 80% of teens in the U.S. are employed at some point during high school.(1) In 2009, 19% of 15- to 17-year-olds in Massachusetts were employed at any given point in time.(2) Even in today's tough economy, with fewer teens working than in past years,(3) we still rely on youth in many industries. We need to do all we can to ensure jobs in which teens are employed are safe. We also need to provide teens with basic health and safety skills that will help protect them now and in the future. Employment can provide many benefits to youth in addition to income: opportunities to take on new responsibilities, learn job skills, explore future careers and, in some cases, improve academic skills. But just like adults, teens are at risk of getting injured at work. In 2007 in the U.S., 48,600 teens under age 18 visited hospital emergency departments for work-related injuries; three times that many teen work injuries are thought to occur every year.(4) And in 2009, 27 U.S. teenagers were fatally injured at work.(5) In fact, young people have about twice the rate of non-fatal occupational injury per hour worked than older workers.(6) Inexperience is a risk factor. Teens also tend to work in jobs that have higher than average injury rates for workers of all ages. In addition, we know that many working teens receive no health and safety training on the job. Having information about where and how young workers are injured on the job is essential to prevent future injuries and to promote safer work opportunities for youth. The Teens at Work: Injury Surveillance and Prevention Project at the Massachusetts Department of Public Health (MDPH) collects data from hospital emergency departments (ED), and workers' compensation (WC) lost wage claims, to identify work-related injuries to teens. WC claims are for injuries resulting in five or more days of missed work, while ED injuries can range in severity. Informed by these data, and interviews conducted with injured teens, Teens at Work collaborates with other agencies and community partners on initiatives to prevent injuries to working teens in Massachusetts. DATA HIGHLIGHTS: From 2004 through 2008, in Massachusetts: 1) Three teens under age 18 were fatally injured while working. 2) 4,019 teens under age 18 visited a hospital emergency department for work-related injuries; that is nearly 3 teens injured for every 100 full-time equivalents. 3) 968 workers' compensation lost wage claims were filed by teens under age 18, for injuries resulting in five or more lost work days. Special highlight: 1) In 2009, nearly one fifth (18%) of Massachusetts middle school students reported working for pay, other than babysitting or yard work. Four workers were involved in the loading operation: two reach stacker operators and two spotters/riggers. When the incident occurred, one rigger was on the railcar, while the other (the victim) had moved to the ground and was walking between the reach stacker and the railcar. When the rigger on the railcar signaled a reach stacker operator to release the tension on the sling, the operator, unaware of the victim's location, moved the reach stacker forward, crushing the spotter/rigger against the railcar. The rigger on the railcar saw the incident and immediately signaled for the operator to back away from the railcar. The operator backed away, dismounted his machine, and then attempted to resuscitate the victim. The company emergency response team and city paramedics were called. Emergency personnel arrived within minutes and performed CPR, but were unable to revive the victim. A few minutes later city paramedics arrived at the scene, but were also unable to revive the victim. The victim was pronounced dead at the hospital due to a crushing injury to the upper torso. He fell a third time about three feet off the truck steps onto his left shoulder, twisting his left knee and low back. Despite the pain, the truck driver continued working. But as he disconnected the trailer, it all caught up with him. He felt a sharp pain traveling to his spine and his arm went numb. The following day he couldn't move. This gritty driver who had toughed it out despite the aches and pains had injured his back, left shoulder, and elbows. It was two weeks before he was able to return to work on light duty. TIPS TO LIVE BY - Employers: Refresh drivers on how to prepare for severe weather by checking their chains and carrying emergency gear. Drivers: Don't risk it - stop driving when conditions are unsafe to do so. Wear work boots with good traction. Cowboy boots are not a good shoe on a slick surface. Before exiting your tractor, and while still sitting in your seat, run your foot across the top step to check for ice. Always use three points of contact and face your truck when entering or exiting the cab. Watch for thin ice on tractor steps, dock steps, cat-walks, ICC bars and in parking lots. When walking around icy spots use handrails and concentrate on foot placement. Clean the windshields and all lights. Keep your winter kit in your truck. Refill your windshield washer fluid with a winterizing, antifreeze fluid. Check the condition of your tires and make sure they are properly inflated. Anticipate or notice changing road/weather conditions by checking weather forecasts. Check cross-traffic mountain pass conditions prior to traveling through an interstate. Increase the following distance, allow extra time. The decedent was working in a barn AB - the north wall of the barn faced the road and the south wall faced a large cornfield. The tractor was facing south. The throttle and gear shift controls were both located on the right side of the tractor. When the operator was in the driver's seat, the operator pushed the throttle lever forward (away from the driver) and the gear lever backwards (toward the driver). Both levers were accessible while standing on the ground, and the lever activation reversed. The decedent was standing on the ground facing the tractor on the tractor's right side, which placed the engine area in front of him with the small front tire to his right and the large right rear tire to his left. It appears that he reached up and in an attempt to activate the throttle (pulling it toward him) he contacted the gear shift lever, pushing it back which placed the tractor into gear. Because the tractor engine was operating at a high rpm, when placed into gear, the tractor went forward at a high rate of speed. The rear tractor tires left spin marks on the concrete floor of the barn. The tractor continued out the south barn door and arced to the north, crossing the road and continuing into a field. The tractor continued its arced path of travel through the field, and then passed between two houses, crossed a north-south road, and finally came to rest against a tree approximately one-third of a mile from the barn. Several of the decedent's family members saw the tractor traveling without the operator and investigated. Seeing the decedent on the floor, they went to the house and notified another family member, who investigated and called for emergency response. Emergency response arrived and declared the decedent dead at the scene. Recommendations: 1. Engage the tractor parking brakes and block tractor movement if tractor maintenance must be performed with the engine running. 2. Have a trained mechanic inspect used equipment prior to use to ensure equipment has all safety features intact and to note any equipment modifications that may affect equipment performance and function. 3. Buyers of used tractors should ask the current owners if they bypassed or removed any safety switches on the tractor that is for sale. 4. Develop and implement a farm safety plan. 5. Routinely inspect tractors to identify potential safety issues, such as old/faded SMV emblems, missing PTO master shield, and roll-over protective structure (ROPS) availability. Install/re-install missing or damaged items. 6. Manufacturers should review with their dealer network trends related to the disconnection, alteration, removal or failure of safety devices to determine possible reasons that may lead to redesign, safety notices, operator's manual notes or other actions. The chop saw the decedent was using to cut re-rod was located approximately two feet from the 55-gallon drum and was within 10 feet of a parts washer that contained lacquer thinner. The waste drum and another 55-gallon drum containing new motor oil were on a rack adjacent to the chop saw. Both barrels were lying horizontally on the rack, approximately 2-1/2 feet above the floor. The waste oil drum had a facet in one bung hole and the other larger hole had a firm-made 2-inch diameter spout, which extended approximately 2 inches and then turned upward at a 90-degree angle for approximately 8 inches. At the end of the spout there was an open funnel used for pouring liquids into the drum. The funnel height was approximately at the same level as the saw. The decedent had cut a piece of re-bar and had placed it on the ground against the building's overhead door rail track when the explosion occurred. Another employee had just arrived and was burned as a result of the explosion. Nearby businesses heard the explosion and saw the fire and called for emergency response. Emergency response arrived and transported the decedent to a nearby hospital where he died later that day. Recommendations: 1. A competent employee should survey work areas to ensure flammables and combustibles are stored appropriately and are not located in the area where spark-producing equipment is used. 2. Townships should utilize both in-house and external resources, such as building inspectors, fire departments, county departments, insurance risk managers, and MIOSHA Consultation, Education and Training (CET), to assist in identifying health and safety issues, such as flammable/combustible material storage and then develop and enforce control measures for these issues. 3. The township should develop and implement a health and safety management system which includes a written health and safety plan, hazard analysis, and employee training for each township department. 4. Employers should ensure drums containing flammable or combustible products are properly grounded when pouring flammable/combustible liquids into them and that the pouring containers are appropriately bonded to minimize static electricity buildup. If a funnel is used to pour flammable/combustible materials into another container, the funnel should be equipped with a flame arrestor and properly bonded. 5. The water and sewer district should develop a standard operating procedure (SOP) for emptying the waste drum. 6. Fire Departments should review business/government agency-supplied hazardous materials data, prioritize this information, and conduct proactive site visits to assist in preventing a fire incident.
