Fatality Assessment and Control Evaluation (FACE) Program

U.S. workplace deaths remain a public health crisis, with over 5,000 annual fatalities concentrated in high-risk sectors like construction, transportation, and agriculture. To address this under the OSH Act, NIOSH runs the Fatality Assessment and Control Evaluation (FACE) program, a non-regulatory initiative providing safety guidance through independent, non-enforcement investigations. Structurally, FACE operates as a unified effort split into two distinct, complementary branches: a centralized, national In-House program run directly by NIOSH, and a decentralized network of State FACE programs funded via cooperative agreements. While both share common goals and methods, they differ significantly in their organizational structure, authority, influence, and how they implement findings locally across diverse regional industries. Together, they generate extensive prevention resources and adapt to emerging workplace hazards.

The operator had worked in the construction industry for 29 years and was a trained lift operator. The victim had worked in the industry for several months. They both had worked at the site for more than three weeks. Working 14 feet above the ground from the elevated platform, the victim and an equipment operator were installing metal siding panels on a building. In front of the platform was a vertical column and an overhead horizontal beam. The operator began to move the lift sideways to the building to position it so that they could install another panel. As the lift began to move, the operator was watching to ensure that he did not hit the vertical column. The operator was just about to retract the boom, when the platform suddenly rotated 90 degrees counter clockwise. This action pinned and crushed the victim between the horizontal beam and the platform's control panel. The operator, unable to access the panel, called for assistance from workers on the ground who were able to operate the lift's ground controls. An investigation found that the victim likely inadvertently activated the platform's rotation switch, which can be done by slight pressure, thereby causing the platform to rotate. Requirements: Employers must make sure that employees who operate elevating work platforms do the following both before and while driving the platform elevated: Maintain a clear view of the path of travel. Keep a safe distance from obstacles, debris, drop-offs, holes, depressions, ramps, and other hazards to safe travel. Keep a safe distance from overhead obstacles. Recommendations: Perform a job/task hazard assessment to identify overhead obstructions and plan how to avoid them. Consider purchasing or retrofitting aerial lifts with an operator protective structure (OPS) to protect workers from being crushed against overhead obstructions. (Employers must have written permission from the manufacturer before modifying an elevating work platform. See WAC 296-869-30020). Equipment manufacturers should design aerial platform controls so that they are protected against inadvertent activation by workers on the work platform. Both workers wore hard hats without chin straps, ear muffs and boots with microspikes. Neither of them carried a radio. At approximately 9 AM, the victim hooked up the last snow gun on the run and started walking down a lower trail (also expert rated) to get to a lift station. The lower trail was icy and not groomed. The partner took the lead traversing to the skiers left side that was less steep and then started descending. He was approximately 30 feet down the trail when he heard the victim calling for help. He turned around and saw the victim sliding down the middle of the trail in a seated position. The victim was trying to stop with his hands and feet but could not. As he was gaining speed, he slid past the partner towards the steeper side (at skiers-right) of the trail and into a wooded area. The partner quickly descended to reach the victim who was unconscious next to the base of a clump of trees. The partner then immediately walked down the trail to the lift station to use a phone to call the ski patrol. The ski patrol rescue team descended from the summit lodge and arrived on scene about 5 minutes after receiving the call. The rescuers extricated the victim and performed CPR while transporting him in a toboggan to the base area first aid station where the victim was pronounced dead by a coroner. CONTRIBUTING FACTORS: 1) Victim worked on a steep slippery trail covered by ice and snow AB - 2) Victim was unable to stop the uncontrolled descent AB - 3) The hard hat fell off victim's head during the fall since it did not have a chin strap. KEY RECOMMENDATIONS: New York State Fatality Assessment and Control Evaluation (NY FACE) investigators concluded that to help prevent similar incidents from occurring, employers of ski resorts and areas should: 1) Conduct a job hazard analysis and implement a comprehensive fall prevention program AB - 2) Explore and implement feasible measures to reduce the frequency of maintenance for snowmaking equipment through upgrading, modifying, retrofitting or replacing the old equipment and system AB - 3) Groom steep and icy trails before allowing snowmaking staff on them AB - 4) Identify high risk areas for slips and falls and design and construct alternate routes for workers to travel AB - 5) Consult with manufacturers and their retail representatives to ensure the right selection of traction footwear for snowmakers and to understand the limitations of such footwear AB - 6) Provide snowmakers with ANSI Type II Class G hard hats with chin straps for head protection AB - 7) Provide snowmakers with training on fall prevention AB - and 8) Provide all snowmakers with radios and require them to carry the radios whenever they are working on the mountains. 9) Develop an emergency response plan to ensure a timely delivery of emergency medical service in case of worker injury. The truck driver exited the highway behind a guardrail and traveled 1,320 feet, striking a wire fence and several trees before plummeting into a creek bed, shearing the cab open. At 10:27 a.m., a citizen called in to the fire department to report a mysterious blue substance observed in the creek a couple of miles down from the accident. The fire department arrived on scene, followed the creek and found the semi in the creek. The driver was extricated by mechanical means by the fire department and declared dead at the scene by the coroner's office. To prevent future occurrences of similar incidents, the following recommendations have been made: Recommendation No. 1: Semi tractor-trailer drivers should routinely receive refresher training to recognize signs of fatigue and drowsiness and when to seek appropriate rest periods. Recommendation No. 2: Never turn off your airbags while driving a tractor-trailer. Recommendation No. 3: Motor carriers need to monitor their drivers' driving records for key violations that indicate a future crash is likely. Recommendation No. 4: Motor carriers should consider regular online safety training that allows drivers the flexibility to complete course(s) at times convenient to their busy schedules. This task involved the operation of a tractor pulling a trailer-mounted, stainless steel 1,000 gallon capacity water tank to dampen the orchard's compacted dirt and gravel roads to suppress dust while the apple pickers were working. The orchard was located on a gradually sloping hill. After the victim finished his lunch break in the upper part of the orchard, he proceeded to drive the tractor with the attached nearly full water tank trailer downhill on an orchard road. The orchard road was constructed of dirt and gravel AB - it was straight, dry, and smooth with an approximate downgrade of 1%. He was not watering down the road at this time. As the incident was unwitnessed, the incident investigators determined that the victim was operating the tractor downhill in a gear ratio that was too high based on the incident scene evidence. The incorrect gear ratio selected would have allowed the tractor and its attached water tank trailer to gather excessive speed. Because of the weight of the water tank trailer and the high speed at which the tractor was traveling, the brakes on the tractor would not have been sufficient to control the momentum of the tractor and water tank trailer. When he attempted to shift to a lower gear ratio, the gearshift became stuck (jammed) in the neutral position, thus allowing for an out of control descent. Following this the victim fell, jumped, or was knocked from the operator's seat. After landing on the ground, his right leg was run over by a tractor wheel followed by his chest and abdomen being run over by the water tank trailer wheels. An orchard foreman summoned the orchard manager, who called 911. The manager arrived within a few minutes and administered CPR to the unresponsive victim until emergency services paramedics arrived. The county coroner arrived and pronounced the victim deceased at the scene. Investigators found the water tank trailer separated from the tractor and lying on its side. The tractor was found resting upright against trees in the orchard. A piece of wire was used instead of a locking safety bolt on the trailer's coupler to hold it on the tractor's hitch. This piece of wire failed just before or just after the victim came off of the tractor. The use of the wire in place of the locking safety bolt allowed the water tank trailer to separate from the tractor. The tractor was determined to be in neutral (out of gear) when examined in the orchard after the accident. Investigators also noted that the tractor did not have a seat belt or rollover protective structure (ROPS). Here in Massachusetts, 44 of the 78 construction worker deaths from 2007-2011 were due to falls. In most cases, the workers who fell from roofs were not using adequate fall protection. Ask the contractor a few simple questions before you sign a contract: Are you licensed? Do you have workers' compensation insurance? (Ask to see a copy of the insurance certificate.) Do your workers work directly for your company? (If they are "independent contractors" they are not covered by workers' compensation.) Will your workers be using fall protection, such as lifelines or guardrails, while on the roof? If the prospective contractor answers "No" to any of these questions, look for another contractor. There's a chance you could share in liability if there were a serious incident on your property. Falls are the leading cause of death among construction workers, and falls from rooftops are the most common type of fall. Even years of experience does not negate the need for safety equipment. The police and fire departments responded to the co-worker's 911 call, but were unable to reach the victim, so additional support was requested. Thermal imaging was used to locate the victim in the tree, and an aerial ladder truck was used to reach the victim. The victim was not trained or certified by any arborist or tree association. The contributing factors identified in this investigation were improper work practices in the removal of dead palm fronds and the lack of correct equipment. The CA/FACE investigator determined that, in order to prevent future incidents, tree care companies and self-employed tree workers who trim or remove palm trees should ensure that: 1. Palm tree trimming or removal is performed or supervised by workers trained and certified by organizations such as the Tree Care Industry Association (TCIA) or the International Society of Arboriculture (ISA). 2. Proper work procedures and equipment are used. In addition, homeowners who need palm trees trimmed or removed should: 3. Hire only tree workers who are trained or certified by organizations such as the TCIA or ISA. In addition, it is preferable that homeowners should only hire companies that have a current tree trimming contractor's license (in states where this is applicable). Also, fire departments in locations with palm trees should: 4. Develop and implement rescue protocols for trapped palm tree trimmers. Requirements - Agricultural employers must: Develop a written accident prevention program tailored to the needs of your agricultural operation and the types of hazards involved. See WAC 296-307-030(2). Conduct an on-the-job review of the practices necessary to perform job assignments in a safe and healthful manner. See WAC 296-307-030(3)(f). Furnish to each employee a place of employment free from recognized controllable hazards likely to cause injury or death. See WAC 296-307-045(1). Ensure that employees are protected from injury. Whenever appropriate, you must ensure that employees use protective clothing; respiratory devices; shields; barriers; and adequate protective equipment for eyes, face, head, and extremities. See WAC 296-307-10005(1). Ensure that employees do not use defective or unsafe tools and equipment. See WAC 296-307-018(2). Warning labels on the accumulator and in the rebuild kit instructions stated that all gas pressure must be released prior to disassembly. However, this step was skipped in the disassembly process and pressurized nitrogen gas remained in the accumulator. While the victim was slowly removing an 8-inch diameter cap from the end of the accumulator, the cap violently exploded off the cylinder and hit the victim in the abdomen and pelvis. The flying cap killed the victim. His co-workers were injured by the cap and related debris. RECOMMENDATIONS: 1) Employers should ensure employees follow manufacturer's recommendations and confirm all pressure is released prior to performing any maintenance work on pressurized systems and components (in this case both hydraulic and gas). 2) Install a "dump valve" in hydraulic systems to ensure hydraulic energy is released from the system when the equipment is shut down. 3) Employers should ensure that all employees are trained to recognize the potential hazard of stored energy and how to eliminate or control it. 4) Employees should be empowered to stop work and re-evaluate a situation whenever potentially hazardous or unusual methods are being used to accomplish a task. 5) Manufacturers or employers should consider altering the placement of warning labels, or applying additional labels or seals, on the cap area of accumulators to ensure they remain visible while removing the caps. 6) Warning labels are a necessary form of safety communication, but label messages should be reinforced in the workplace through additional person-to-person communication. We completed a case-series study of 2005-2009 occupational fatalities captured by Iowa's Fatality Assessment and Control Evaluation (FACE) Program. The goals of our research were to: (1) measure the proportion of FACE cases that undergo toxicology testing, and describe the factors associated with being tested, and (2) measure the rate of positive toxicology tests, the substances identified and the demographics and occupations of victims who tested positive. Case documents and toxicology laboratory reports were reviewed. There were 427 occupational deaths from 2005 to 2009. Only 69% underwent toxicology testing. Younger workers had greater odds of being tested. Among occupational groups, workers in farming, fishing and forestry had half the odds of being tested compared to other occupational groups. Of the 280 cases with toxicology tests completed, 22% (n = 61) were found to have positive toxicology testing. Commonly identified drug classes included cannabinoids and alcohols. Based on the small number of positive tests, older victims (65+ years) tested positive more frequently than younger workers. Management, business, science, arts, service and sales/office workers had proportionately more positive toxicology tests (almost 30%) compared with other workers (18-22%). These results identify an area in need of further research efforts and a potential target for injury prevention strategies. This averages to approximately 66 cases per year. Over half of all pesticide exposures reported to IDPH happened in the months of May through August. Male was the most common gender reported (63%) and age groups of 20-29 and 30-39 made up around half of the exposures. Of all exposures, 65% were "targeted" which is the exposure to a pesticide that was released at the target site and not carried away by air. Applying, mixing, transporting and disposing of pesticides were the most common activity during the exposure. 60% of exposures had a contributing factor of not wearing the appropriate personal protective equipment. Almost half (47%) of the cases went to the emergency room for evaluation and another 39% only used poison control advice as medical treatment. Disinfectants made up over 60% of the cases of pesticide exposure reported to IDPH. An exposure that caused some type of health reaction to the skin, eye or respiratory track but resolved without medical treatment made up 82% of the cases. 26% of reports had signs or symptoms of the eyes, followed by 22% for the skin and 23% for the respiratory system. A co-worker noticed the victim was not moving and grabbed the sleeve of his shirt and pulled him away from the machine. The co-worker then yelled for help and another co-worker called emergency medical services (EMS). The local fire department was on site to inspect the sprinklers and were summoned and started to care for the victim. The local police and then the state police arrived at the incident location. The victim was transported to a local hospital where he was pronounced dead. Contributing factors identified in this investigation included a lack of comprehensive standard operating procedures for lockout/tagout as part of an overall hazardous energy control, the location of the machine's electrical junction box that was both physically and visually inaccessible, and the victim working extended hours to limit the disruption of production. The Massachusetts FACE Program concluded that to prevent similar occurrences in the future, employers should: 1. Ensure that electrical circuits and equipment are de-energized and that lockout/tagout standard operating procedures are implemented and enforced prior to beginning work AB - 2. Provide and ensure that employees use appropriate personal protective equipment (PPE) and tools for troubleshooting live circuits AB - 3. Develop, implement, and enforce an Injury and Illness Prevention Program that addresses hazard recognition and avoidance of unsafe conditions AB - and 4. The excavation had been partially completed the day prior to the incident and completed the day of the incident. The excavation was approximately 40 feet long by 14 feet wide by 14 feet deep. The excavation walls were nearly vertical and were not shielded or shored against collapse. It rained the night prior to the incident. On the day of the incident, the excavator operator lowered an empty 20,000-gallon, 10-foot-wide by 37-foot-long by 8-foot-high water tank that weighed approximately 5,700 pounds onto a one-foot-deep sand base. The tank was anchored via tie down straps to concrete deadman anchors. The decedent and another coworker were on the east side of the excavation getting ready to exit when the northwest corner of the excavation collapsed into the excavation causing the tank to pivot in a clockwise direction. The decedent was pinned by the tank against the east wall of the excavation. The excavator operator moved the tank to the west, freeing the decedent. Coworkers administered CPR while emergency responders were enroute. Emergency responders entered the excavation and continued resuscitative efforts. The decedent was declared dead at the scene. Factors: 1. Excavation walls inadequately sloped/shored 2. Qualified person and employee training inadequate 3. Soil conditions. The split piece came away from the tree, striking the decedent. The remainder of the tree was still standing. The farmer, who was working in the field at the time of the incident, came to investigate when he saw the tree move unexpectedly. The farmer found the decedent in a sitting position, pinned face first to the ground with the split piece of wood on his back and called for emergency response. The decedent was declared dead at the scene. Factors which may have contributed to this fatal incident include: 1. The amount of lean of the tree 2. Improper felling technique. All four fell to their deaths from ladders. As with most work-related fatalities, these could have been prevented. Plan ahead: Choose the right ladder for the job. Choose a ladder that can support you and your tools and check the ladder's duty rating label. A self-supporting step ladder, straight ladder, or extension ladder may be what you need to get the task done safely. If the task cannot be done safely from a ladder, use scaffolding or a lift. Ensure your ladder is in good working condition. A self-employed Massachusetts painter fell 14 feet from an extension ladder while painting the exterior of a house. The ladder was found to be damaged in several places: it had bent rungs and side rails and damaged feet. Ladders should be inspected for damage before each use. Check for cracked, loose, or slippery rungs, split side rails, or worn shoes. Make sure the rung locks are in working order. If ladders have any defects, they should be immediately removed from service and marked defective or tagged with "Do not use" so others know not to use them. At the worksite: Set up the ladder correctly - it's essential. A Massachusetts painter scraping paint on the exterior of a house fell 18 feet when his ladder slipped out from under him. The ladder was not tied off or secured and was footed on composite decking. The base should be set on dry, level ground or other secure, even surface. To avoid slip-out, the ladder must be set at a proper angle of one foot out for every four feet of ladder height, and the base and top of the ladder should be secured. See "Resources" on back of sheet for ways to secure your ladder. When using an extension ladder to access an upper level, the ladder should extend three feet above the roof edge. Use the ladder properly: A Massachusetts painter was preparing to paint the inside surface of a gutter at a home. He climbed the unsecured extension ladder holding a 2.5 gallon bucket of paint and fell from the ladder to the ground. Use a tool belt or hoist to transport your materials up the ladder and secure your paint to the ladder to keep a hand free to hold on. Face the ladder and maintain three-point contact with the ladder while climbing and while painting. Overreaching to the side or leaning away from the ladder to paint overhangs can lead to falls. Keep your belt buckle centered between the ladder side rails at all times. Climb off and reposition the ladder as needed. Do not work from the top three rugs of an extension ladder or from the top or top step of a step ladder. Personnel from the local fire and police departments arrived within minutes of the call. The victim was transported to a local hospital where he was pronounced dead. The Massachusetts FACE Program concluded that to prevent similar occurrences in the future, employers should: 1. Ensure that when employees are located within a tree, they use a minimum of two means of being tied in the tree at all times AB - 2. The victim had worked for his employer, an HVAC contractor, for the previous four years. On the day of the incident, the victim and two other company employees were performing routine maintenance on rooftop HVAC units. The commercial building roof where they were working was flat and had unguarded skylights. The workers were not using fall protection. After they had been working for about four hours changing belts on HVAC units, the victim needed to go to their work van to get a belt. A coworker gave him the vehicle keys. As the victim was walking away from the coworker, he turned back towards him and began speaking to him. He then tripped on the lip of an unguarded skylight and fell through it. He landed approximately 26 feet below on a concrete floor. Requirements: Develop and implement a written fall protection work plan including each area of the work place where the employees are assigned and where fall hazards of ten feet or more exist. See WAC 296-155-24611(2). When employees are working in the vicinity of skylights which have been installed and are not capable of sustaining the weight of a two hundred pound person with a safety factor of four, one of the following fall protection measures shall be implemented: See WAC 296-155-24609(4)(d) A standard guardrail system; Cover or screen; A personal fall arrest system consisting of a body harness, lanyard, connectors, and anchor points. Personal protective equipment (PPE). Wherever hazards exist employers must: Do a hazard assessment for PPE use; Provide proper PPE; Train workers on safe PPE use. (PPE alone should not be relied on to provide protection for employees. PPE should be used after all other reasonable means of reducing hazards have been carried out.) A hazard assessment should be completed by employers before employees perform rooftop work, whether that work involves maintenance or construction activities. Architects, designers, contractors, and building owners should consider guarding skylights with screens or guardrails to protect workers who must perform work on rooftops. The victim had been employed for 14 years by a small general contractor who primarily did residential work, but also did commercial and industrial jobs. On the day of the incident, the victim and a laborer were at a job site, where they had worked for the past month, adding an addition to a commercial building. They used a ladder to access the top plate of the unfinished single-story structure where they intended to place a rim joist. They had previously been working from ladders and, according to the laborer, intended to return to working from the ladders once they placed the rim joist. Fall protection gear was available on-site, but they did not use it. As they were moving the rim joist into place, the laborer was standing on the top plate and the victim was standing on 6½-inch-wide beam, when the victim fell 12 feet 7 inches to a concrete surface. The laborer called emergency services, who transported the victim to a hospital, where he died of head injuries two weeks later. Requirements - The employer must: Ensure that the appropriate fall protection system is provided, installed, and implemented according to the requirements in Chapter 296-155 WAC, Part C-1 Fall Protection Requirements for Construction when employees are exposed to fall hazards of four feet or more and working on any surface that does not meet the definition of a walking/working surface not already covered in WAC 296-155-24609. See WAC 296-155-24611(1)(c). Develop and implement a written fall protection work plan including each area of the work place where the employees are assigned and where hazards of ten feet or more exist. See WAC 296-155-24611(2)(a). Train employees in the requirements of the fall protection work plan. See WAC 296-155- 24611(2)(b). Recommendations: Conduct a daily pre-task job hazard analysis to identify potential fall hazards so that work can be completed safely. When installing joists consider minimizing fall hazards by using methods such as a mobile scaffold, wall bracket scaffold, or catch platform.
