Fatality Assessment and Control Evaluation (FACE) Program

U.S. workplace deaths remain a public health crisis, with over 5,000 annual fatalities concentrated in high-risk sectors like construction, transportation, and agriculture. To address this under the OSH Act, NIOSH runs the Fatality Assessment and Control Evaluation (FACE) program, a non-regulatory initiative providing safety guidance through independent, non-enforcement investigations. Structurally, FACE operates as a unified effort split into two distinct, complementary branches: a centralized, national In-House program run directly by NIOSH, and a decentralized network of State FACE programs funded via cooperative agreements. While both share common goals and methods, they differ significantly in their organizational structure, authority, influence, and how they implement findings locally across diverse regional industries. Together, they generate extensive prevention resources and adapt to emerging workplace hazards.

The dump truck involved in the incident was loaded with asphalt and located inside the construction site. The task to be performed was to finish paving a small section of a turnout that was located inside the construction site immediately north of an intersection. The dump truck driver was asked by the general contractor to back to the unfinished section of the turnout approximately 1,000 feet away. The victim was standing at the edge of the construction work zone in the closed northbound right-hand travel lane. He was facing oncoming traffic and had his back to the backing dump truck when he was struck and backed over by the truck. Two witnesses, a mother and her child, stopped to report the incident. Calls were placed for emergency assistance and the victim was pronounced dead at the scene. The Massachusetts FACE Program concluded that to prevent similar occurrences in the future, employers should: 1. Develop, implement, and enforce an internal traffic control plan (ITCP) specific to each construction site to reduce backing of construction vehicles. 2. Ensure backing protocols are in place and that designated individuals are assigned as signalers to direct backing construction vehicles on construction sites. 3. Ensure that communication exists among equipment operators and workers on foot. In addition, local and state government agencies should: 4. Consider offering work zone safety training for all municipal officers who perform traffic details. In addition, manufacturers of heavy construction equipment, such as dump trucks, should: 5. Explore the possibility of incorporating collision avoidance technology on their equipment to assist the operator while backing. The mixer wagon was designed to be hooked to the drawbar of a tractor and operated via the tractor's PTO and hydraulic systems. The design enabled a worker to completely operate and unload the wagon while seated in the tractor seat. The wagon's PTO shaft was fitted with a tubular safety shield. At the front of the wagon was a short master shield fastened to the wagon. Although the PTO shaft was entirely enclosed in a tubular safety shield and the short master shield covered the end of the shaft, a small gap existed between the two safety shields. The wagon was equipped with a hydraulically controlled discharge chute located at the wagon's left front corner to unload it. The victim had mixed several loads of feed on the day of the incident. After filling the mixer wagon, the victim engaged the tractor's PTO to begin mixing the feed while he drove the tractor to a dairy barn equipped with several feed conveyors to unloaded the wagon. After stopping the tractor and wagon near a conveyor, he got off the tractor and started the barn conveyor. After starting the conveyor, he probably reentered the tractor cab and started the wagon's discharge augers but then exited the cab again. While the wagon emptied, he entered the area between the rear of the tractor and the front of the wagon. He may have stepped on the tractor drawbar and reached through the cab's open rear window to reach the hydraulic controls and either increase or decrease the flow of feed from the wagon. While doing so, he apparently fell backward and his clothing became entangled in the end of the PTO shaft near the front of the wagon. Another worker became concerned when the tractor and wagon remained parked longer than normal. He walked to the scene and found the victim entangled in the PTO shaft which had broken. He ran from the scene and notified other workers who placed a call to emergency personnel. The workers returned to the scene, freed the victim and laid him on the ground. Rescue personnel arrived shortly after being notified and pronounced him dead at the scene. MN FACE investigators concluded that, in order to reduce the likelihood of similar occurrences, the following guidelines should be followed: 1. Machinery should only be operated or adjusted when the operator is seated in the operator's seat AB - 2. When his final cut failed, he decided to let the set-back stand and move on to a large red oak located 11 feet to the side and slightly uphill from the standing maple. The maple was 10 inches in diameter at breast height (DBH) and 65 feet tall. The oak was approximately 40 inches DBH. After felling the oak, he walked down hill to begin topping it. He positioned himself on top of the oak about 40 feet downhill from the maple. As he began his first cut, a gust of wind blew the set-back over. Two of his employees, who witnessed the incident, reported that they saw the set-back begin to fall toward him. They yelled a warning to the victim but he was unable to hear them due to his running chainsaw. The victim was struck from his right rear receiving severe multiple injuries to his upper body. One of the workers drove the skidder to the operation's landing site and notified a truck driver who then called the local EMS. The other worker remained with the victim for approximately 30 minutes, at which time the EMS arrived and pronounced the victim dead. The WV FACE Investigator concluded that, to reduce the likelihood of similar occurrences, employers should: 1. Ensure that tree fellers utilize felling wedges in addition to proper felling techniques on trees with back lean. 2. Ensure that set-backs are immediately removed mechanically before continuing any work. 3. Ensure that company policies and practices concerning hazard abatement are consistently followed by all. Both victims worked for a company that specialized in refurbishing and repairing railroad equipment. The empty railroad tank car had been filled with soybean oil, and the headspace (unfilled volume) inside the tank car was filled with a cover gas (in this case nitrogen) to prevent spoilage. Although this was a hazardous condition for workers, at the time of the incident, the tank car did not have any permanent or temporary exterior warning signs or marking to alert workers that a hazardous gas was present. On the day of the incident, the first foreman (first victim) was attempting to assess the extent of repairs from inside the tank car. He used a portable multi-gas meter to measure the air quality inside the car, and reported to a co-worker accompanying him (attendant) that the air inside was fine. He then entered the tank car through the top hatch, while the attendant stayed just outside. A short time later, the attendant heard the foreman drop his flashlight, and looking in, saw him lying on the floor of the car. The attendant assumed the foreman must have bumped his head or experienced a heart attack. In turn, he called local emergency response (911), and also radioed for help over the company's radio system. While emergency help was en-route, the second foreman (second victim) arrived at the scene with another company employee. The second victim immediately asked the attendant about the air quality inside the tank car, and was told by the attendant that the air inside was fine. The second victim then entered the tank car followed closely by the other company employee. Once inside the car, the second victim almost immediately collapsed against the other company employee's feet and on to the floor of the tank car. Since the other company employee was still coming down the entry ladder he was able to stop and immediately climbed back outside the tank car to await assistance from emergency personnel, who arrived within a few minutes. The rescue crew first checked the air inside the tank car with their equipment, and found little or no oxygen inside. Then rescuers donned self-contained breathing apparatus and extracted both men, who had died from asphyxiation. Although nitrogen gas occupied the entire interior of the tank car, no permanent or temporary markings or placards were found on the exterior of the tank car to alert workers of this hazard. The portable multi-gas meter used by the first victim was found to be working perfectly after the incident, and also during official tests conducted sometime later. Recommendations based on our investigation are as follows: 1. Employers must ensure that all components of a comprehensive confined space entry program are in place, emphasized, enforced and utilized by workers regardless of a lack of an apparent safety hazard. 2. Employers should provide safety equipment to confined space entrants designed to permit their extraction from outside the confined space, and ensure that workers properly use such safety equipment. 3. Employers must insure that workers testing air quality inside confined spaces are trained not only to conduct these tests, but to conduct them regardless of the situation or lack of an apparent safety hazard. 4. Employers must verify that emergency response services are available and that the means of summoning them is operable before an entry into a confined space is initiated. 5. The bin was built in 1986, and other bins were grouped around it over the next 2-3 years. The original ladder to this bin was attached on the north side, with a concrete pad below on the ground. A smaller bin was built immediately next to this bin, leaving less than adequate clearance for the ladder, which made it somewhat difficult to climb the ladder in a normal fashion. When using this ladder, one would need to lean slightly to the right. While grinding feed with his son, the farmer was climbing down the ladder after checking the grain bin. He fell approximately 10-12 feet (3-3.6 m) and hit his head on the concrete slab. He was able to get up, and went to lie down on the lawn and his son called 911, against his father's wishes. The man was taken to a local hospital, then, transferred to a regional hospital by helicopter. He lost consciousness and rapidly deteriorated and died the next day from his head injuries. Recommendations based on our investigation are as follows: 1. Tall grain bin ladders should be constructed according to standards for fixed ladders. 2. Grain bin ladders should be free of obstructions. 3. Fall-arrest systems should be developed for grain bins, and they should be an integral part of the grain bin design. One of these doors led to the outside, and the other to an alleyway between the two confinement buildings. The ERWC room contained a toilet, sink, shower, small shelves, a combination electric clothes washer/dryer unit, hot water heater, and a stationary high pressure hot-water power washing unit. Just prior to the incident the victim was outside the swine confinement buildings servicing farm equipment. He entered the ERWC room through the outside walk-in entry door, closed the door behind himself and went to use the toilet. The other walk-in entry door from the alleyway between the buildings was closed. In the meantime, a co-worker in another room of the swine buildings connected a spray nozzle and hose to the piping system and began to power wash/clean that area. After roughly 15 minutes, the co-worker stopped washing and went to the ERWC room to use the rest room facilities. After entering, he noticed that both walk-in entry doors were closed, then saw the victim lying face down on the floor in front of the toilet, with his pants at his ankles. The co-worker immediately turned the victim over and found him unresponsive. He began to administer CPR, but stopped just long enough to open up the room (co-worker felt dizzy and did not want to be overcome himself). After 10 to 15 minutes the co-worker contacted the local emergency response by dialing 911. Within 15 minutes the emergency crew was at the scene, but by this time the carbon monoxide gas had dissipated in the ERWC room. The victim was transported to the local area hospital where he was pronounced dead. Recommendations based on our investigation are as follows: 1. Employers must ensure that all combustion-powered appliances, equipment and systems are properly installed. 2. Employers must ensure that all personnel performing installation, removal, operation, and maintenance activities on combustion-powered equipment and systems are properly trained in such function, including hazards that may be produced. 3. Employers should install, test and maintain a monitoring system designed to measure the concentration of carbon monoxide gas and warn employees of its presence in any enclosed space where combustion-powered appliances, equipment and systems are installed and/or utilized. 4. Employers must insure that their facilities means of ingress/egress are continually maintained free of obstruction or impediments to full instant use in the case of fire or other emergency. The man was moving a small pile of dirt from the farmyard to the feedlot to repair soil erosion next to a building and a feed trough. The area was slightly sloped to the Northeast. The farmer had a full load of dirt in the raised front-end loader bucket. He had just entered the feedlot area, and turned left towards the concrete feed troughs, positioning the tractor to unload the bucket. The overturn was not witnessed and the conditions leading to the overturn are not fully clear. The findings suggest that a combination of several factors may have resulted in the overturn. These factors include narrow front of the tractor, raised front end loader with a heavy load, moving slightly downhill, slightly uneven ground, turning left, and slowing down while turning. These factors may have added to the momentum at this critical point sufficiently overturning the tractor to the right. The tractor rolled 180 degrees, coming to rest upside down. The farmer was crushed underneath and killed instantly. This tractor had no Rollover Protective Structure (ROPS), which would likely have saved this man's life by preventing a complete rollover. However, for this fairly common tractor model, there are no commercially available ROPS on the market. Recommendations based on our investigation are as follows: 1. All tractors should be equipped with Roll Over Protective Structures (ROPS). 2. ROPS should be designed for all common tractor makes and models. 3. Narrow-front (tricycle type) tractors should not be equipped with front-end loaders. He was using the bucket of the excavator to push over a 105-foot maple tree that was about 18 inches in diameter at breast height. It was raining hard with winds blowing 15 to 20 miles per hour. The top of the tree leaned over the excavator's cab as the victim attempted to push the tree sideways with the left side of the excavator bucket. He opened the excavator cab door and leaned out to look up and was struck in the head by a falling dead tree limb measuring about 5 inches in diameter by 12 feet long. The limb fell from a height of about 85 feet. The victim was not wearing a hard hat. The skid steer's load was approximately 3 feet off of the ground. A short length of 2X4 had been placed on the ground beneath the load to help stabilize it. It is believed that the victim first leaned out over the safety bar, to remove the short length of 2x4 with a hammer from his tool belt. His hammer was not long enough and the victim raised the safety bar and leaned his body outside of the protective operator's cage in an attempt to again remove the 2X4. Witnesses at the scene stated that the victim's tool belt contacted the actuators in the operator's cage and the lift assembly lowered while he was leaning outside the operator's cage. According to the equipment manufacturer both the operators seat and safety bar are interlocked on this model and the hydraulics should not have raised or lowered the lift, had they been working properly. The OR FACE program received notice of this workplace fatality from a news service. The employer declined a site visit and interview. This report is based on information obtained from the local police report of the incident, information from the loss control specialist of a building trade association and various news reports. Recommendations: 1. Never modify, defeat, or override safety features. Similarly, never operate equipment in which safety systems or features have been modified or are not working properly. 2. Do not leave the protective operators enclosure while operating equipment. Turn off the equipment before exiting the enclosure. 3. Only trained skid steer operators should be allowed to operate equipment. 4. Take care to remove or properly stow items that could interfere with the safe operation of equipment. At the time of the incident, the victim was still on the roadway between the farm and field location and was attempting to make a 90 degree turn in the road when the tractor-trailer rolled over, coming to rest on the driver's side. The victim was trapped partially in the cab of the manure truck, and as the window had been open, the victim's head was outside and underneath the door of the truck. The owner of the farm was at the accident location, and immediately called for help. The emergency squad arrived within eight minutes AB - the victim was pronounced dead at the scene by the coroner. New York State Fatality Assessment and Control Evaluation (NY FACE) investigators concluded that to help prevent similar incidents from occurring in the future: 1. Tractor-trailers should be driven at operating speeds appropriate for roadway conditions AB - 2. The soft snow covered bank gave way causing the tractor to slide sideways down the bank then overturning. The tractor landed upside down pinning the victim. The tractor did not have a rollover protective structure (ROPS) or a seat belt. The victim's wife came out to check on her husband and found him pinned under the tractor. She called EMS which arrived within minutes and found no signs of life. The body was extricated and transported to the local funeral home. The cause of death was listed as traumatic asphyxia as well as chest and head trauma. The WV FACE investigator concluded that to reduce the likelihood of similar occurrences, the following guidelines should be observed by tractor owners: 1. Equip all tractors with ROPS and a seat belt. 2. Demarcate and/or barricade bank edges near barns, storage areas, and work zones. On the day of the incident, the victim and a co-worker were assigned to clean two dough machines, an "elevator" and a "divider". The "elevator" had three major components: a lifting mechanism, a hopper, and a steel blade ("dough chunker") that was located at the bottom of the hopper. The facility's lockout/tagout procedure required an operator to set the control buttons of the "dough chunker" to "Off" and "Manu" before turning off the main power switches. Prior to the incident, the victim turned off and locked the power switches, but left the "dough chunker" controls set to "On" and "Auto". The victim and the co-worker then proceeded to clean the machines. At approximately 4:15 PM, the co-worker was ready to clean the dough bowl on the "elevator". In order to clean the outside of the bowl, he had to have the bowl raised by the "elevator". He went to the victim and asked him for the key to unlock the main power switch to the "elevator". At this point the victim was in the middle of cleaning the inside of the "elevator" hopper. He was standing on a metal stair, bending over and extending his head through the bottom opening of the hopper and wiping the inside of the hopper with a rag. When asked, the victim gave his key to the co-worker. The co-worker walked to the control panel, unlocked the main power switch, turned it on, and started raising the bowl. A few seconds later, the co-worker heard noises made by the victim. He immediately pushed the emergency stop button to stop the machine. The co-worker rushed to the victim and saw that the victim appeared to be partially decapitated from behind by the energized steel blade. The co-worker called the shift supervisor for help. The shift supervisor summoned the paramedics who arrived within five minutes. The victim was pronounced dead at the scene and was transported from the accident site to a local hospital morgue. New York State Fatality Assessment and Control Evaluation (NY FACE) investigators concluded that to prevent similar incidents from occurring in the future, employers should: 1. Conduct periodic inspections to ensure that company lockout/tagout procedures are being strictly followed AB - 2. The tow rope was attached to a ripper tooth on the dispatched grader. During the towing process, the ripper tooth broke loose and was slung forward and struck the victim in the back of the head. Co-workers called for help via a two-way radio. An ambulance arrived at the scene within 25-30 minutes, but the injuries sustained by the worker were sufficiently severe to cause death within two hours of the incident. Develop written procedures to safely tow equipment using work practices that provide protection from flying parts that could break loose during the operation. 2. AB - A food production worker died after suffering a deep cut to his neck from a steel blade on a dough machine. On the day of the incident, the victim and a co-worker were assigned to clean the dough machine. The victim turned off the machine and locked the main power switch, but missed setting one of the three blade control switches to its lockout position. As the victim was cleaning a hopper above the blade, the co-worker asked him for his key to unlock the main power switch of the dough machine. The victim handed the key to the co-worker who turned on the machine. This caused the dough blade to go through its automatic cutting cycle, fatally injuring the victim. HOW CAN THIS BE PREVENTED? Provide employee training to ensure workers understand lockout/tagout programs. Conduct periodic inspections to endure lockout/tagout proceduress are followed. Modify cleaning procedures to avoid placing workers' bodies into points of operation. Install interlocks to eliminate possible human errors during machine maintenance and sanitation. Department of Public Health AB - On October 25, 2001, a 35-year-old male boat handler (the victim) was fatally injured when he was crushed underneath a 33-foot vessel. The victim was part of a marina yard crew using a hydraulic trailer to haul boats out of the water for the winter season. The boat involved in the incident had been removed from the trailer and placed onto boat stands, which were designed to stabilize but not completely support the boat's weight. The victim crawled under the boat in an attempt to add wooden blocks at the rear of the boat's keel to support the boat's weight, when the boat fell on him and crushed him. A resident from across the street placed a call for emergency assistance and personnel from the local police and fire department and emergency medical services (EMS) responded to the scene within minutes. OSHA and the medical examiner's office were then also contacted and responded to the scene a short time later. The medical examiner pronounced the victim dead at the incident site. The Massachusetts FACE Project concluded that to prevent similar occurrences in the future, employers should: 1. Ensure that employees inspect how the boat is sitting on the boat trailer before completely hauling the boat out of the water. 2. Establish and enforce standard operating procedures (SOP) for hauling boats and storing them out of the water. 3. Ensure that boats are stored on stable ground. 4. Establish and enforce a comprehensive health and safety program, including but not limited to, providing training for boat handlers on hazard recognition and safe work practices for assigned tasks. 5. Develop a health and safety committee that includes worker participation and meets regularly. The two incidents below involve workers who died when there was a failure to deenergize and lockout/tagout a piece of equipment before they worked on it. MECHANIC CRUSHED IN ESCALATOR: A 37yearold escalator mechanic, Jorge H.* (* Not the victim's real name), died when he was crushed in an escalator while performing maintenance. Jorge had removed the escalator stairs and crawled inside the mechanism of the escalator. A coworker dropped the escalator's electrical circuit box. This triggered a relay and sent power to the escalator. The stairs began moving. Jorge could not get out before the power was turned off. There were no locks or tags on the power controls to the escalator. The disconnect switch at the circuit panel that fed power to the elevator had not been locked and tagged out. No blocks or mechanical devices had been used to keep the escalator from moving. WELDER CRUSHED TO DEATH BY SHREDDER: A 52yearold welder, Jeff K.* (* Not the victim's real name), died when he was crushed to death by a hydraulic door on a scrap metal shredder. Jeff was trying to remove a jammed piece of metal from the hydraulic door. The system's energy had not been released and the door had not been blocked open. Jeff had not deenergized and locked out the machine. He cut the jammed piece of metal with a torch. The jam fell away and the door closed on him. The company did not require a supervisor's visual confirmation of deenergization and lockout/tagout prior to maintenance work. RECOMMENDATIONS: Workers should: Be sure machines are deenergized and locked and tagged out before they do maintenance. Block machines from moving before doing maintenance. Employers should: Consider requiring that workers be directly supervised during lockout/tagout. The victim then instructed the new employee to take his foot off the clutch, causing the tractor to lunge forward running over the victim. A call was placed for emergency assistance and emergency responders arrived within minutes to the site. The victim, conscious and alert requested to be transported to a local hospital. He was subsequently transported to a larger hospital where he died a few hours later. The Massachusetts FACE Program concluded that to prevent similar occurrences in the future, employers should: 1. Evaluate the safety of all company owned tractors and retrofit older models with new safety equipment in accordance with manufacture's specifications. 2. Develop, implement, and enforce a standard operating procedure (SOP), which would include but not be limited to, prohibiting employees from standing in-between the front and rear wheels of a tractor while starting the tractor or while the tractor is running. 3. Develop, implement, and enforce a standard employee training program for training equipment operators. 4. Develop, implement and enforce a written comprehensive health and safety program. The forklift operator placed four more bundles directly on top of the bottom four and left to load another truck. The victim tightened the first strap closest to the cab on the driver's side, then moved to the next strap. While using a torque bar to tighten the strap, the movement of the bottom bundle caused the upper bundle to slide off, striking the victim in the head, landing on top of the victim from the waist up. Approximately 15 minutes later the forklift operator noticed the bundle missing and laying on the ground and went to his supervisor's office and reported the incident. The supervisor ran out to the yard, assessed the situation and ran back into his office to call 911. Local emergency personnel responded and transported the victim to a local hospital where he was pronounced dead. The Nebraska Workforce Development, Department of Labor's Investigator concluded that to help prevent future similar occurrences, employers should: 1. ensure that all employees are trained according to applicable regulations in the safe use of powered industrial trucks. 2. ensure that employees abide by written/verbal policies regarding the proper loading/securing of product. 3. ensure that employees are able to communicate required safety information in a language/method understandable to all parties involved.
