Fatality Assessment and Control Evaluation (FACE) Program

U.S. workplace deaths remain a public health crisis, with over 5,000 annual fatalities concentrated in high-risk sectors like construction, transportation, and agriculture. To address this under the OSH Act, NIOSH runs the Fatality Assessment and Control Evaluation (FACE) program, a non-regulatory initiative providing safety guidance through independent, non-enforcement investigations. Structurally, FACE operates as a unified effort split into two distinct, complementary branches: a centralized, national In-House program run directly by NIOSH, and a decentralized network of State FACE programs funded via cooperative agreements. While both share common goals and methods, they differ significantly in their organizational structure, authority, influence, and how they implement findings locally across diverse regional industries. Together, they generate extensive prevention resources and adapt to emerging workplace hazards.

The decedent and his coworker were in the process of removing eight dead ash trees on the course. The incident ash tree was assessed and damage noted approximately 36 feet above the ground. Additionally, one of the ash tree's limbs was wedged in an adjacent tree to the north. The desired fall path was to the south. To fell the tree, the decedent made a 6¾-inch Humboldt-style notch on the south side of the tree approximately 32 inches from the base of the stump. The decedent made a downward diagonal back cut, at an approximate 45-degree angle and in approximately 6½ inches, into the north side of the tree. The decedent had retreated 24 feet to the west between a stand of trees after making his cuts. At some point in the process, the decedent made a horizontal cut from the south side of the tree into the existing hinge wood leaving approximately ¼-inch of hinge wood remaining. When the tree did not fall, the decedent returned to the tree to make further cuts and the tree began to fall. The decedent then retreated to the north. Instead of falling to the south, the tree began to fall to the north, in the direction of the decedent's retreat. The tree in which the ash limb was wedged apparently placed excessive pressure on the ash tree's damaged area causing the ash tree to snap at approximately the 35 foot mark. The top 48 feet of the ash tree fell at an east/west axis and the base of the tree fell to the north. The decedent had retreated approximately 27 feet from the ash tree when he was struck in the back by the falling tree. The decedent's coworker contacted emergency response. Emergency response arrived and transported the decedent to a local hospital where he was declared dead. Recommendations: 1. Employers should ensure workers have appropriate training prior to beginning work and not assume that a worker who has relevant past experience performing a task has an appropriate level of expertise to perform the task. 2. Employers who have employees conduct tree trimming and removal operations should ensure a job briefing is performed by a qualified individual/arborist prior to any tree removal operation. 3. Employers should conduct a hazard assessment to determine if job tasks require the use personal protective equipment (PPE). If PPE is required, employers should perform the required employee training and develop procedures to ensure its use. 4. Employers should develop a written safety and health program that includes employee education and training and that reflects the composition of the business. In this incident, the employer should develop a safety and health program for the kitchen, the restaurant/banquet center, the golf course operation/maintenance group, etc. 5. MIOSHA should update General Industry Safety Standard, Part 53, Tree Trimming and Removal to include applicable requirements from MIOSHA Standard Part 51, Logging to address tree removal safety issues and reference the most recent Z133 Committee consensus standard for safety practices for arborists. The decedent and two coworkers arrived at the worksite and wanted to haul the construction trailer from the worksite. The decedent, against company policy, climbed onto the seat, pulled the Kill switch, and started the machine. The machine stalled, and he started it again. The machine was in first gear. When he applied power, the machine started forward. The front driver's side front tire drove up and over the trailer tongue hitch, puncturing the tire. The machine articulated (bent in on itself), and then overturned. Either the decedent was trying to jump from the machine as it articulated or he was thrown from the machine as it overturned. He was pinned under the machine's rear passenger side tire. His two coworkers attempted to get the machine off of him by placing a car jack at the location of the tire that pinned the decedent and attaching a chain to the loader arm and the pickup truck they arrived in. When they were unable to lift the machine from him, the coworkers called for emergency response. Upon emergency response arrival at the site, his vital signs were absent. Emergency response personnel began the recovery operation. Recommendations: 1. Construction employers should identify all equipment that can articulate and determine if a steering frame articulation lock is present and functional. If a lock is not present, the employer should determine the feasibility of installing such lock AB - if the lock is not functional, the equipment should not be used until the lock is repaired. 2. Employers should develop and communicate a written safety and health plan that includes the actions an employee should take in an emergency situation. Independent contractors who work for employers need to be given the same information. The employer should require employees to call for emergency assistance immediately upon discovery of the emergency. Recommendations to Emergency Responders: 1. Fire Departments/Emergency responders should request companies to report the type of heavy equipment they have and should include an inventory of such equipment when they perform training program evaluations. In the interim, employers utilizing unusual heavy machinery and/or construction equipment should identify such equipment and send this information to their local emergency responders to assist them in responding to an emergency. 2. Emergency responders should periodically review procedures for implementing a lifting and stabilization plan. 3. Emergency responders should consider utilizing community resources, such as wreckers, to assist with extrications. The parking lot was dark and inadequately lit because two corner pole lights located at each corner end at the rear of the parking lot were not functional. There was one white mercury vapor lamp functional AB - the light was located behind the open parking space to be used for the gravel train. The parking area was located west of the maintenance shop and had two wide driveways located at its north and south to provide access to the lot. There were two truck rows with a large open area between them. The driver of the Peterbilt was a truck mechanic who had a suspended driver's license and did not have a commercial driver's license (CDL). He was driving the recently repaired gravel train from the maintenance shop, utilizing the north driveway, to park the vehicle two spaces to the north of the decedent's parked vehicle. The semi-tractor's amber/running lights were on but the tractor's headlights were turned off. The mechanic drove past the open parking space, turned the truck around in the wide open area, and headed back to the open parking space. As he began to make his turn into the open space, the driver's side of the tractor struck the decedent. Emergency response was called and the decedent was declared dead at the scene. Recommendations: 1. Employers should mandate the use of vehicle headlights in parking lots when the vehicles are moving during dusk through dawn hours. 2. Employers should institute a training/awareness program to educate shift work workers, especially those working 12-hour shifts at night, about sleep/fatigue management and the potential safety and health issues, such as "sleep debt". 2. Employers should develop an interior/exterior facility inspection checklist to identify and remedy safety and health concerns, such as non-functional pole lights. 3. Employers should establish both vehicle traffic flow and pedestrian walkways within a parking lot. 4. Employers who utilize commercial vehicles should identify and include in their Michigan Department of State Driver Database subscription service any employee who operates the vehicle for any reason, including maintenance personnel. 5. Employers should establish and utilize a health and safety committee as an integral part of their safety and health management system. Possible scenarios include an unintentional fall from the second floor landing or a fall from the top of the knee wall as he was attempting to unscrew the fixture's set screws. He was found by an individual walking past the first set of stairs lying on the 5- by 5-foot landing. The individual who discovered the decedent indicated the decedent was unconscious, lying on his back and appeared to be breathing. This individual ran to a nearby office to call for emergency response. Emergency response arrived and the decedent was transported to a local hospital where he was pronounced dead. Recommendations: 1. Employers should review stairway lighting to identify safety issues related to maintenance and develop an approach to ensure worker safety. 2. The church should develop a Health and Safety management program, which should include the formation of a Health and Safety Committee and a job hazard analysis. 3. The church should identify the edge of the second floor landing/stairway. 4. The church should replace existing light bulbs with bulbs that require less frequent changing. 5. Building designers should consider and discuss lighting maintenance issues with the building owner during the design process. While raising the ladder to the vertical position, the workers lost their footing and the ladder fell towards and came in contact with energized overhead power lines. Two co-workers were shocked and thrown to the ground. The victim was electrocuted and the ladder fell to the ground landing on top of him. Once the two co-workers regained mobility, they went to assist the victim. One of the coworkers placed a call for emergency medical services (EMS) and then placed a second call to the employer. The local police arrived followed by EMS within minutes of the call. The victim was transported to a local hospital where he was pronounced dead. At the time of the incident, the multi terrain loader's lift arm had a fork attachment connected to it and the lift arm was in a raised position. The victim had positioned a step ladder underneath the loader's raised lift arm against the loader's cab and it appears that the victim was standing on the ladder at the time of the incident. A co-worker returning to the worksite found the victim crushed between the loader's lift arm, which was now in the lowered position, and the cab. The co-worker placed a call for emergency medical serviced (EMS). Within minutes EMS arrived and the victim was pronounced dead at the incident location. The Massachusetts FACE Program concluded that to prevent similar occurrences in the future, employers should: 1) Ensure that safeguards and interlocks are functioning properly, used and are never bypassed AB - 2) Ensure that the lift arm cylinder lock is engaged prior to exiting a multi terrain loader's cab during maintenance tasks requiring the lift arm to be in the raised position AB - 3) Ensure employees only start or access the controls of a multi terrain loader when seated in the loader's cab AB - 4) Develop, implement and enforce lockout/tagout procedures for maintenance tasks that include the use of the cylinder locks when the lift arm is required to be in the raised position AB - 5) Ensure employees are not performing potentially hazardous tasks alone in isolated areas AB - and 6) Develop, implement and enforce a safety and health program that addresses hazard recognition and avoidance of unsafe conditions. The victim, who was working alone, had driven his van inside the empty warehouse and parked near the offices he was assigned to clean. He ran his truck-mounted gasoline-powered carpet cleaner for several hours until he succumbed to the CO generated by the carpet cleaner. To prevent similar occurrences, the Washington State FACE Program published the following recommendations for businesses engaged in commercial carpet cleaning: 1. Do not use gasoline or other fuel-powered engines, equipment, or tools inside buildings or areas where carbon monoxide can build up. 2. Work with manufacturers to re-design the truckmounted carpet cleaner so that the unit more effectively reduces or eliminates carbon monoxide in the exhaust gases or prohibits exhausting into the van and work areas. 3.Ensure carbon monoxide detectors with alarms are used when employees work with fuel- powered engines in environments where CO is likely to build up. 4. Use a "Risk Assessment" or "Job Hazard Analysis" tool to identify potential carbon monoxide sources and exposures and how to avoid them. 5. Educate workers regarding hazards, sources, symptoms and control of CO exposure. 6. Ensure that employees work in pairs on new or unfamiliar jobs and that a continuous communication plan is in effect. 1. Do not use gasoline or other fuel-powered engines, equipment, or tools inside buildings or areas where carbon monoxide can build up. The FACE program recommends that companies park similar truckmounted carpet cleaning units outdoors with no exceptions. Workers should strategically park their vehicles outside in a manner that would prevent CO from entering the building through doors, windows, or air intake vents. Opening windows and doors may not provide adequate ventilation to make a work safe indoor environment. When work must be done inside buildings, warehouse locations, or other semi-enclosed areas it is recommended that one use equipment with engines powered by electricity or compressed air. Workers should never be in the van when the fuel-powered truck-mounted carpet cleaning unit is operating and exhausting into the immediate environment. 2. Work with manufacturers to re-design the truckmounted carpet cleaner so that the unit more effectively reduces or eliminates CO in the exhaust gases or prohibits exhausting into the van and work area. Employers should work with manufacturers to re-design and engineer carpet cleaning and other internal combustion engine equipment with safer emission controls. An effective control device would be a real time exhaust gas CO sensor capable of shutting the engine off at specific CO levels. Oxygen (O2) sensors can also monitor exhaust gas, while catalytic converters are effective emission control devices. Truck-mounted cleaning systems should also be designed and maintained to prevent exhaust gases from entering the vehicle and work environment by diverting exhaust gases. Leak proof exhaust hoses can be used to accomplish this. 3. Ensure CO detectors with alarms are used when employees work with fuel-powered engines in environments where CO is likely to build up. Personal CO monitors should be used whenever a fuel-powered generator is used as an energy source and there is potential for CO to accumulate. Personal CO monitors should provide a means of direct reading of CO exposure concentrations with preset alarm warnings for hazardous concentrations (see Photo) and should have both visual and audible alarm and warning functions. Fixed site ambient CO monitors should also be used near the CO source. CO monitors should be capable of recording and responding to peak CO concentrations and average CO exposures over time WA FACE recommends that CO monitors be set to activate the alarm or warning at an exposure concentration of 35 parts per million (.0035%) which is the level generally accepted to have no adverse health effects in healthy humans. Any CO alarm or warning should initiate evacuation. 4. Use a "Risk Assessment" or "Job Hazard Analysis" tool to identify potential CO sources and exposure and how to avoid them. CO gas is a colorless, odorless, chemical asphyxiant. Therefore, it is crucial that a thorough risk assessment or job hazard analysis be carried out by an employer to identify possible sources of CO which can be hazardous to exposed workers. A risk assessment or job hazard analysis for CO exposure should include these steps: 1.Identify all potentially exposed individuals and groups. 2.Identify the processes, tasks, and areas where hazardous exposures could occur. 3.Analyze the potential health risks of the hazardous exposures (e.g., compare against occupational exposure limits). 4.Estimate probability and severity of potential exposure. 5.Assess, measure, and verify the exposures if prompted by #4. 6.Identify hierarchy of control measures from engineering to PPE. 7.Analyze the effectiveness of existing control measures. 8.Determine if new or additional control measures are needed. 9.Set priorities for action. 10.Develop, implement, and monitor a risk control action plan or review existing risk control action plan. 11.Maintain accurate and systematic records or amend existing risk control action plan and use alternative and/or additional control measures.12.Review and amend at regular intervals or earlier if changes to processes or new developments are proposed. Employers should conduct follow up assessments in the field to ensure workers both understand and know how to apply the training and instruction at the work site. 5. Educate workers regarding hazards, sources, symptoms, and control of CO exposures. Employers should use the results of the risk and job hazard assessment to educate their employees regarding CO and how to prevent exposures while doing their job. Employers should contact the equipment manufacturer for safety guidelines and operating procedures. This information should be used to provide employees with equipment specific safety instruction. 6. Ensure that employees work in pairs on new or unfamiliar jobs and that a continuous communication plan is in effect. Employers should evaluate the potential hazards faced by solitary workers and assess the risks to them and should ensure that measures are in place to control or avoid such risks. These measures should include employees working in pairs, especially when dispatched to new or unfamiliar job sites or remote locations where safety may be a concern. Employees should be trained to continuously monitor the status of their co-workers and how to respond in an emergency. In addition to working in pairs, employers should develop plans for maintaining continuous communication between employees and with their supervisors or dispatchers. The communication plan should have redundancies where possible to deal with equipment issues and guidelines that are strictly followed when there are breaks in communication. In this incident, there was a disruption in communication between the manager and employee which may have been caused by faulty communication equipment or the status of the employee. The break in communication should have prompted the employer to respond or send emergency response to the scene. Situations where an employee is unresponsive and may have been incapacitated by a toxic exposure should be approached with extreme caution by trained emergency responders. Numerous multiple fatality incidents have resulted from responders or rescuers attempting to aid another employee in a toxic environment without first monitoring and remediating the environment to ensure safe entry. Violence was the second most common category of events in 2008, with 9 involving suicide, mostly related to financial crisis and family problems. A higher proportion of incidents than usual involved middle-aged workers, aged 45-64. Violence accounted for one-fourth of the incidents. All suicide victims were aged 48-58. Only one incident involved an older worker, aged 77. Transportation and contact events involving mobile machinery and heavy trucks were a principal source of fatal injury, including tractors and farm machinery, dump trucks, construction equipment, trailer rigs, a skidder, and an all-terrain vehicle. A higher proportion of incidents than usual involved middle-aged workers, aged 45-64. Violence accounted for one-fourth of the incidents. All suicide victims were aged 48-58. Only one incident involved an older worker, aged 77. Transportation and contact events involving mobile machinery and heavy trucks were a principal source of fatal injury, including tractors and farm machinery, dump trucks, construction equipment, trailer rigs, a skidder, and an all-terrain vehicle. The victim entered the bin, something the lifelong farmer had done many times, to hold back and meter spoiled corn as it mixed with other corn flowing toward the grain vacuum at the side door below. He became entrapped and then engulfed in the flowing grain. The victim in this event, which was not witnessed, was recovered by emergency medical services (EMS) personnel and transported to a local hospital where death was pronounced. The cause of death was determined to be asphyxiation due to submersion in grain within a bin. Recommendations: 1. Place signs warning about the hazards of confined spaces at all entrances to bins. 2. Allow no one to enter or be inside a bin during loading or unloading. 3. If a grain bin must be entered, use a safety harness and three-person team for the entry. 4. Break up surface crusts or clumps from outside the bin. During the lowering process the employer used an unorthodox method, supporting the house with several screw jacks and wood columns, bracing the columns to prevent lateral movement. The victim and four other employees were beneath the house lowering the jacks when the bracing failed. The house dropped 20 inches and shifted laterally six feet. Four workers escaped unharmed, but the victim was pinned between two pieces of lumber and the floor joists of the house's deck. He died at the scene. The wooden platform, also referred to as a "catch" platform, was intended to collect debris generated by work on the bridge deck. However, it was not uncommon for workers to use the platform as a walking or working surface. The victim fell through the temporary wooden platform immediately after he stepped down from a steel structural I-beam onto one of the wooden planks, which broke into two large pieces. The road and bridge construction company was working on a bridge located on a major New Jersey highway when the fatal event occurred. The company employed union laborers for this large-scale, multi-year construction project. NJ FACE investigators recommend following these safety requirements and guidelines to prevent similar incidents: 1. Personnel working at heights of six feet or greater should have effective fall protection and prevention. 2. Temporary surfaces that are accessed and used by personnel must be designed, maintained, and inspected to assure that they are safe. 3. Surfaces that are not designed for worker access use must be clearly identified and entry to those areas must be prevented. 4. Wooden planks or other materials used for temporary work platforms and the supports that hold them in place must be designed and made of material that can support at least four times the maximum intended weight. 5. Catch designs and/or construction procedures that hold individual planks together to prevent shifting of the planks should be employed. 6. Employees must be trained to report any problems with wooden decking planks that might be damaged or planks that have their integrity compromised. Companies must designate a person to actively survey the planks and promptly replace any planks that have compromised integrity. 7. A safety and health plan based on a job hazard analysis should be developed by the employer and followed for each communications tower where workers are assigned tasks. The victim noticed that a section of aluminum pipe measuring 4 inches in diameter by 24.5 feet long was clogged with dirt. The employer had trained this and other employees to unclog dirt from irrigation pipe sections by connecting the pipe to the water main and using water pressure to blow out the dirt. He then picked up the pipe and started to knock the dirt loose inside the pipe by hitting it on the ground. The pipe contacted a 7200 volt overhead power line that was 19 feet above the ground, causing the victim to be electrocuted. A co-worker who was in an adjacent aisle accessing the top section of a rack heard the crash and then found the victim underneath the metal grates. Co-workers cleared the grates away from the victim, started cardiopulmonary resuscitation, and placed a call for emergency medical serviced (EMS). Within minutes EMS and the local police and fire departments arrived at the incident location, and the victim was transported to a local hospital where he was pronounced dead. The Massachusetts FACE Program concluded that to prevent similar occurrences in the future, employers should: 1) Ensure that infrequently accessed materials stored within rack systems are secure by using supplemental cables or gates across the front of the rack AB - 2) Install guards on the rear of racks in back-to-back setups to reduce the chance of disrupting materials in adjacent racks AB - 3) Develop, implement, and enforce a comprehensive written safety and health program that includes topics related to warehouse operations such as safe storage of items, retrieval of stuck items, and safe operation of powered industrial trucks and provide training in languages on these topics that employees can comprehend AB - and 4) Ensure that all federal and state required trainings and licenses for forklift operators are valid and up-to-date. A blind spot is the area around a vehicle or piece of construction equipment that is not visible to operators, either by direct line-of sight or indirectly by use of internal and external mirrors. Use Spotters wearing reflective vests when the driver has an obstructed view; the truck contains extended components (such as a crane); or when someone or something could enter the driver's backing path.
