Fatality Assessment and Control Evaluation (FACE) Program

U.S. workplace deaths remain a public health crisis, with over 5,000 annual fatalities concentrated in high-risk sectors like construction, transportation, and agriculture. To address this under the OSH Act, NIOSH runs the Fatality Assessment and Control Evaluation (FACE) program, a non-regulatory initiative providing safety guidance through independent, non-enforcement investigations. Structurally, FACE operates as a unified effort split into two distinct, complementary branches: a centralized, national In-House program run directly by NIOSH, and a decentralized network of State FACE programs funded via cooperative agreements. While both share common goals and methods, they differ significantly in their organizational structure, authority, influence, and how they implement findings locally across diverse regional industries. Together, they generate extensive prevention resources and adapt to emerging workplace hazards.

The silo is 50 feet in height and 14 feet in diameter and has a bottom unloader. The sweep auger of the unloader circles the silo floor, moving corn towards a center hopper and the exit auger located underneath the silo floor. The exit auger transports and deposits the corn to a collection container outside the silo. At the time of the incident, there were approximately eight inches of corn on the silo floor. The decedent went inside the silo alone and proceeded to shovel and move the corn towards the center area of the silo and into the hopper. The sweep auger had been left on to aid in the removal of corn. It was rotating and circling while the decedent was inside shoveling. The decedent finished cleaning out one side of the silo and was proceeding to clean the other side. At approximately 9:00 p.m., minutes after the father last saw his son, the father discovered that the decedent was caught by the sweep auger. It appeared that the tip of the sweep auger, which is approximately 10 to 12 inches from the silo wall, caught the decedent's pant leg. The father immediately shut off the unloader and called 911. Even though the emergency responders arrived at the scene quickly, they were unable to save the youth. He was pronounced dead at the scene by the coroner at 9:25 p.m. The cause of death was due to multiple crushing injuries. CONTRUIBUTING FACTORS: Occupational injuries and fatalities are often the result of one or more contributing factors or key events in a larger sequence of events. The New York FACE investigation identified the following key contributing factors in this incident: 1. Lockout/Tagout procedures were not followed. Power to the silo unloader was left on, which provides power and drive to the sweep auger. 2. Standard Lckout/Tagout procedures detailing how to lock out the unloader before entering silo for cleaning or maintenance tasks did not exist. 3. Occupant, the decedent youth, was in the silo with the sweep auger rotating and circling around the silo. 4. The sweep auger was not guarded. 5. The protruding objects on the sweep auger increased the risk of entanglement. 6. The lighting inside the silo was inadequate. 7. The occupant, the decedent youth, was in the silo alone with no attendant outside to aid or rescue. 8. The decedent youth, who was assigned to work in an environment with high risk of entanglement, may have lacked the maturity to understand the nature of the risk due to his age. RECOMMENDATIONS/DISCUSSION: 1. Farm owners should ensure that no one enters a silo unless the power to the sweep auger is turned off and locked out. 2. Farm owners should deploy engineering controls to prevent workers from contacting energized sweep augers. 3. Farm owners should implement a safe silo/grain bin entry procedure to eliminate confined space hazards and ensure entrants' safety. 4. Farm owners should provide adequate artificial light source to illuminate silo interior. 5. Farm owners should ensure that no one wears loose fitting clothing around rotating or revolving machinery. 6. Farm owners should assign age-appropriate tasks to farm youth and provide proper training and supervision. He was doing this job entirely on the inside of the building where he was working from a stepladder. Around 8 a.m., for an unknown reason, he went onto the already sheathed 4/12 pitch roof on the backside of the house. He was not wearing his personal fall protection harness; he had left it in his vehicle. The sheathed roof was wet with dew. While on the roof, he fell 25 feet to the ground below. He was hospitalized with serious injuries. The three other crew members did not witness his fall and the injured framer had no memory of the incident. Investigators determined that the company owner, who arrived on the scene after the incident, had been previously cited by DOSH safety compliance for his employees, including the framer, not using fall protection when required. REQUIREMENTS: Fall protection on low-pitched roofs. The employer must ensure that employees exposed to fall hazards of four feet or more while engaged in work, other than roofing work or constructing a leading edge on low-pitched roofs use one of the following: (a) A personal fall restraint system; (b) A personal fall arrest system; (c) A positioning device system; or (d) A warning line system. RECOMMENDATIONS: FACE investigators concluded that to help prevent similar occurrences: Employers should, 1. Conduct pre-shift safety meetings to determine if workers will be doing tasks that put them at risk of falls and reinforce the need for fall protection. 2. Perform unannounced fall protection spot checks to ensure workers maintain 100% tie-off. 3. Effectively enforce their written safety program. 4. Workers should use employer provided fall protection. The Massachusetts FACE Program received notification from the Massachusetts Department of Fire Services that the worker had sustained burns to an estimated 75% of his body and was being treated at a regional trauma center on September 26, 2019. On November 6, 2019, a representative from the Office of the Chief Medical Examiner notified FACE that the worker had died from his injuries on November 5, 2019. On December 10, 2019, a representative from the Massachusetts FACE Program spoke with the owner of the gas station to discuss the incident. Several records were reviewed during the investigation. The records reviewed included local and state police reports AB - the reports from the state police unit assigned to the Office of the State Fire Marshal to investigate fires, explosions, and arson AB - the electronic death registration system AB - OSHA records AB - and information from the welder and window washer fluid manufacturers. CONTRIBUTING FACTORS: Key contributing factors identified in this investigation include: Worksite lacked a proper welding station AB - Welding in the vicinity of a drum containing flammable materials AB - and Lack of a safety and health program and overall safety training. RECOMMENDATIONS: The Massachusetts FACE Program concluded that, to help prevent similar occurrences, employers should: 1) Provide an appropriate location to perform welding work. All hot work should be a safe distance away from flammable and combustible liquids. The worker had around six to twelve pieces of 12-foot long, half-inch wide pipe loaded evenly and in equal number on each side of him. The pipe was sticking out of the front and back of the ATV. He declined help from a co-worker driving another ATV to transport some of the overloaded pipe that made his vehicle unstable. On the way to the orchard, the two workers drove on a gravel access road to an intersection with a paved state highway. The road had a slight decline where it met the highway. The worker with the pipe was in the lead. He tried turning right from the road onto the highway's southbound shoulder but lost balance and control from the momentum and pipe blocking his steering ability. He rolled across the centerline into the northbound lane where an oncoming passenger truck going the 60 mph speed limit struck the ATV with the left front side of a horse trailer it was towing. The worker was ejected from the ATV and died at the scene. Following the incident, investigators found: 1. The employer did not ensure that workers followed the ATV manufacturer's guidelines to not have any loads that were not secured to the vehicle's front and/or rear cargo racks. 2. The employer did not provide helmets nor ensure that workers wore them per manufacturer's guidelines. 3. The employer did not prohibit workers from driving ATV on highways and public roads, including shoulders, in accordance with state vehicle and traffic rules and vehicle manufacturer's guidelines. 4. The employer did not ensure that workers were provided with proper hands-on ATV safety training. REQUIREMENTS: 1. Employers must maintain conditions within the workplace that will not endanger the health, safety or welfare of employees. WAC 296-800-11005 RECOMMENDATIONS: FACE investigators concluded that to help prevent similar occurrences employers should: 1. Provide DOT-compliant helmets and develop APP requirements and training for ATV, UTV, and other off road vehicle operators to wear them during vehicle operation. He was driving the UTV from a shop building to pick up blueberries at an orchard. He had to travel 3.5 miles on paved county roads to the orchard. A passenger car was approaching him from behind in the same eastbound lane. The car driver was 16-years-old and had just received his driver's license. The speed limit was 55 mph, but there were no traffic signs or streetlights in the area. It is unknown if the vehicles had their lights on. As the car caught up to the UTV, it struck it from the rear and pushed it 310 feet, nearly the length of a football field, before coming to a stop in an orchard adjacent to the road. First responders pronounced the worker dead at the scene. Following the incident, investigators found: 1. The employer's accident prevention program (APP) had a motorized vehicle policy that did not mention the UTV manufacturer's safety guidelines to prohibit driving the vehicle on public roadways. 2. The employer's motorized vehicle policy did not specify county traffic and vehicle ordinances that restricted off-road motorized vehicles, including UTVs, from driving upon county roads. While it is unknown if the UTV's lights were on when the predawn collision occurred, state law requires vehicle lights to be on a half hour after sunset to a half hour before sunrise. The employer's motorized vehicle policy did not include these lighting requirements. 1. Employers must maintain conditions within the workplace that will not endanger the health, safety or welfare of employees. FACE investigators concluded that to help prevent similar occurrences employers should: 2. Use a utility trailer or road safe/legal vehicle to transport UTV, ATV, and other off-road vehicles to worksites to have them avoid using public roads when such use is deemed unsafe by vehicle manufacturers and/or restricted by local ordinances. 3. As part of their APP, do a job hazard analysis (JHA) of tasks involving farm vehicles and equipment that may pose risks. Workers should be involved in creating the JHA. 4. Make sure APP policies and safety training instruct UTV, ATV, and other off-road vehicle operators to follow manufacturer's safety guidelines and local vehicle and traffic rules. 5. Develop APP policies that require UTV, ATV, and other off-road vehicle operators to turn on lights and wear DOT-compliant helmets and reflective, high visibility clothing in poor visibility conditions. A vibratory pile driver was used to install sheet piles at the existing bridge abutment. CONTRIBUTING FACTORS - Key contributing factors identified in this investigation include: 1) There was only one main hoist line holding the pile driver because the crane's auxiliary hoist was not assembled and rigged AB - 2) The sheet pile was not rigged to the crane through a safety line AB - 3) Workers were not trained on how to safely operate the vibratory pile driver. RECOMMENDATIONS - New York FACE investigators concluded that, to help prevent similar occurrences, employers should: 1) Ensure that piles are always secured to the crane via a safety line for as long as the piles are being held by the crane. 2) Ensure that all workers are protected from being struck by the load of a crane during pile driving. 3) Ensure that the hydraulic clamp bolts are inspected and evenly tightened to the appropriate torque as specified by the manufacturer. The driver was employed by a trucking company that hauled gravel to worksites and moved other companies' heavy equipment to and from sites. He had experience transporting and operating construction equipment. A construction contractor doing residential site preparation work had hired the employer to transport a backhoe from their premises to a job site and return it when they were finished using it. On the day of the incident, the driver drove his employer's dump truck with an attached flatbed trailer to the job site. His task was to load the backhoe onto the trailer and transport it to another site. While the incident was unwitnessed, evidence at the scene suggests that the driver was operating the backhoe in reverse, as the backup warning alarm was sounding when first responders arrived on the scene. It is possible that the driver had started moving the backhoe up the trailer's two metal ramps, and then backed up to better position its wheels. As he was doing this, the wet, muddy tires may have slipped on the ramps resulting in a rear wheel going off the ramp, causing it to rollover on its side. Either the driver, who was not wearing the backhoe's seatbelt, attempted to jump from the operator's seat or he was thrown from it as the backhoe rolled over. He was crushed under the backhoe's rollover protective structure (ROPS). The backhoe had a seatbelt that was functional. If he had used the seatbelt, it would have kept him in the seat as the backhoe rolled on its side. REQUIREMENTS: Seatbelts must be provided and used by all operators on earthmoving equipment. Develop and implement a formal, written Accident Prevention Program (APP) tailored to the needs of the particular plant or operation and to the type of hazard involved. RECOMMENDATIONS: FACE investigators concluded that, to help prevent similar occurrences, employers should: Train equipment operators and ensure they always use a seatbelt when operating equipment, including when loading and unloading onto or off a transport trailer. Use a spotter to provide directions to the equipment operator during loading and unloading to ensure that the operator positions equipment correctly for safe movement on and off the trailer. Create a job hazard analysis (JHA) for safely loading and unloading construction equipment on and off trailers. He ran toward a ladder at the front of the trailer that went down to a walkway behind the tractor. While trying to descend the ladder, he went over the edge of his trailer and fell to the road. The only other driver at the mill left the site without seeing the incident. Almost two hours later, another truck driver entered the site and found the driver fatally crushed under his tractor's left front drive wheels. The driver was at a sawmill in Washington State picking up a load of woodchips for a pulp mill in British Columbia. It was his second and last load of the night. He parked his truck on a road at a fall protection tarping station that he used to access the top of his trailer to level his load. The road had a 2% downhill grade, and the driver did not set his parking brake before he left the cab. While the driver was walking on top of his load near the back of his trailer, his truck began to roll forward. He ran on his load toward a ladder at the front of his trailer that went down to a walkway behind the tractor. He fell to the road at some point after he went over the edge of his trailer to climb down the ladder. The only other driver at the mill was parked behind him but left without seeing the incident. Around two hours later, another truck driver pulled into the worksite and found the fatally injured driver crushed to death under his tractor's left front drive tires. CONTRIBUTING FACTORS: Key contributing factors identified in this investigation include: Parking brake requirements in APP not followed. Inadequate truck parking brake policy in APP. Lack of rollaway response procedure in APP. Ineffective worksite and driver safety audits. RECOMMENDATIONS: Washington FACE investigators concluded that, to help prevent similar occurrences, employers should: Develop parking brake policies in APP that require using the safest rollaway prevention and response practices. Install electronic parking brake systems that automatically apply the parking brake when the driver has not set it before exiting the cab. Ensure that safety supervisors can travel to conduct safety audits at shipper and customer sites located across national borders. Request shippers and customers to perform recurring worksite safety audits. The operator had been employed by the hop farm for about eight months. On the day of the incident, the operator and four coworkers were harvesting hops in a hop yard. The hop vines had been grown on a trellis system composed of a grid of steel cables suspended by wooden poles. The vines were suspended vertically from cables running the length of the rows with cross cables over the rows to strengthen the system. The operator and a coworker operated a combine harvester to gather and process the hop vines from the steel cables. The coworker was driving the harvester at the front and the operator was on an elevated platform in the rear. The operator's job was to ensure the vines were being processed and the hop cones were moving from the rear harvester chutes, onto the conveyor, and into the following truck. The coworker said that he lowered the harvester to go under an overhead cross cable and then raised it after clearing the cable, just as he always had. Shortly after, he heard a loud noise and stopped the machine. He said it sounded like metal hitting metal. When he turned around, he noticed the operator was down on the platform. He called for help. The operator was carried to the ground and lifesaving efforts were started. The operator had an injury on his chin where he had apparently been struck by the cable. None of the other workers witnessed the incident, but some reported hearing the loud noise. The operator suffered a broken neck due to blunt force trauma and later died. Following the incident, investigators found: 1. The hydraulic systems on the harvester were functioning properly when examined. 2. The steel cable and a bolt on the top of the harvester showed signs of damage, possibly due to the cable being caught on the bolt. 3. A few poles that suspended the cables were leaning in the direction of the harvester, possibly due to the harvester striking and tensioning the cable. 4. Another operator reported that he had also experienced the cables getting caught and dangerously releasing while working at the rear of the harvester. He said he had learned to stoop to avoid them. RECOMMENDATIONS: FACE investigators concluded that to help prevent similar occurrences employers should: 1. Design hop growing trellises in a way that eliminates or reduces the hazard of overhead cross 2. Add guarding to the front of rear platforms to protect operators. 3. Reduce snag hazards on the top of machinery by using round socket-head bolts or domed bolt covers. 4. Train harvester drivers to maintain safe distances between harvesters and overhead cables. 5. Train and encourage workers to report hazardous conditions so they can be corrected before an injury occurs. The apprentice was employed by a structural steel and precast concrete contractor. His employer was a subcontractor erecting the steel structure of a new construction cold storage facility. He had worked for the employer for about two months. On the day of the incident, two ironworkers were working from the basket of a boom lift to install a beam on a column. This procedure generally took them 30 seconds to a minute before they quickly moved on to the next install. The ironworkers were using a steel wedge between the column and beam to help tighten the bolts securing them. One of the ironworkers was removing the wedge, which was under pressure, using a hammer to knock it loose. As he was doing this, the untethered wedge broke free, but he was unable to hold on to it, and it fell approximately 50 feet. At this moment, the apprentice was in the area below getting a bottle of water that was being stored there for workers. As he was bending over to pick up the bottle, the wedge struck him in his upper back near his left shoulder. The apprentice suffered injuries to his shoulder, ribs, and lungs that kept him from working for several months. Investigators found: The employer had not provided workers with a means of securing wedges from falling or being dropped. The employer had not used red caution tape to keep workers out of the area below where the ironworkers were working. There was not a designated water station. The ironworkers did not expect anyone to be working below them because there were no other workers in the area. RECOMMENDATIONS: FACE investigators concluded that, to help prevent similar occurrences where workers may be in danger of being struck by dropped objects, employers should: in danger of being struck by dropped objects, employers should: Plan ahead and train: Use red caution tape and/or have a spotter on the ground to keep workers from entering areas where objects may be dropped. Locate employee water stations away from active work areas. Provide safety training to new workers to ensure they understand the hazards associated with the work site. Prepare tools and equipment: Require that wedges and other tools used by workers at heights have lanyards, tethering devices, holsters, buckets and other devices to secure them. Add attachment points to wedges if they do not have them so they can be secured to a tether. Ensure that tethering systems are ANSI/ISEA 121-2018 Dropped Object Prevention Solutions compliant. Secure wedges and other tools, both when in use and not in use. The crew was in the process of adding the final 20-foot section to the self-supporting tower. They were using a triangular lattice gin pole to "stack" the tower sections. They had just jumped, or raised, the gin pole into position in order to lift the final section. They used a jump plate to help lift and position the gin pole. The plate was a 6-foot long square steel tube with a steel loop welded in the center. The climber was in the process of unbolting the plate so they could lower it to the ground. He removed the last bolt that secured the plate to the tower and then leaned back. When he did, he fell 260 feet to the ground. The climber did not connect either pelican hook of his fall arrest Y-lanyard to an anchor point on the tower. The plate was still attached to the winch line when it swung down and struck his coworker in the chest. An investigation found that: The employer had developed safe rigging and lifting plans for the job and had provided all required personal protective equipment (PPE) and training to the workers. The climber's harness, D-rings, lanyards, and pelican hooks were not defective and in safe working condition. The crew and employer were unable to identify circumstances that did not allow him to tie-off. REQUIREMENTS: This employer was not cited for violating any safety standards. RECOMMENDATIONS: FACE investigators concluded that, to help prevent similar occurrences: Establish and maintain a communication system among all workers on site and ensure workers on the tower communicate and confirm step-by-step procedures anytime they change positions or perform tasks that require them to detach and reattach their fall arrest systems. Frequently reinforce training on proper use of fall protection equipment with emphasis on always maintaining one point of attachment and reattaching immediately after detaching so that workers maintain 100% tie-off while on the tower.
